2. There is no implied warranty made by auctioneer or sale company as to the merchantability or fitness for a particular purpose of any animal in the sale.
3. The highest bidder is to be the buyer. If any dispute arises between or among two or more bidders, sole authority to settle the dispute as he sees fit is reserved by the auctioneer and the decisions shall be final. Seller reserves the right to waive the sale of his horse before it leaves the ring. The auctioneer reserves the right to reject any or all bids. 4. The Sales Management is not responsible for the integrity of any specific bid and the seller understands and assumes all responsibility for any bid that is made and not there- after honored. In the event any bid is not honored, the seller agrees not to hold the Sales Management responsible and agrees not to sue the Sales Management therefore.
5. All horses are offered for sale according to the laws of the State of Nebraska and the right to bid is reserved for all sellers at the sale unless otherwise announced.
6. Effort has been made to insure correctness of this catalog and, in most cases, information quoted concerning the horses is taken from the official AQHA records. However, em- ployees and auctioneers will not assume responsibility for errors or omissions, but appreciate having them called to their attention. Announcements in the ring take precedence over printed information. Pay close attention to the announcements. 7. The seller is the responsible party for all representations or warranties, expressed or implied concerning the condition of any horse and buyers should satisfy them- selves concerning the condition of any horse they purchase. Except as otherwise announced by the auctioneer at the time of sale, the consignor of each animal represents and warrants to the buyer and Pitzer Ranch Sales to include but not limited to the following: 1. Title of the animal, free from all adverse claims to ownership, use or posses- sion. 2. The animal is sound of eyes and wind. 3. The animal is not a cribber or wind sucker. 4. The animal does not or has not been nerved, or have a hard bone condition causing lameness that makes the horse lame during the two weeks before the checks go out to the consignors. 5. The sex or condition as a gelding or ridgeling is as de- scribed in the sale catalog or announced at the time of sale. 6. Any animal which, at the time of sale is described as a stud or colt and does not at such time have two testes descended to the scrotum must be announced. Warranty with respect to descended testes does not apply to any horse sold prior to Jan. 1 of his yearling year. 7. The horse does not possess the defect commonly known as parrot mouth. If any conditions are announced, the consignor is held harmless for the condition. 8. All guarantees are made by the owner. Make sure to call ahead with questions, take advantage of the previews and pre - inspect horses prior to purchasing as title passes as horse leaves the ring. Right of recourse must be directly to the owner of the horse.

10.In the event a dispute should arise as to a particular defect which should have been, but was not announced as described above, the buyer has the right to have a veterinarian examine the horse he has purchased to determine if the horse suffers from the defect. This examination is to be made and Pitzer Ranch is to be notified before the checks are mailed. If the purchaser ’ s veterinarian determines the horse to have alleged defect, the Sales Management, as agent, shall appoint a veterinarian of its choice to determine if the horse has the defect(s) and if the defect was present at the time of sale. His or her decision will be final. If Pitzer ’ s veterinarian determines that the defect was present at the time of the sale and it was not announced, the sale of said horse shall be null and void and the consignor must pay entry fee and commission. If the horse is determined by the Sales Management veterinarian not to have the alleged defect, the sale of said horse is valid and enforceable and purchaser assumes all costs of examination, treatment, and sale purchase price. In settling disputes, the decision by Pitzer Ranch is final. 11. If the buyer rightfully rejects the animal in the manner stated in #10, the animal will be returned by the buyer to the consignor and the full purchase price of the animal will be refunded. 12. The seller guarantees all mares were bred to stallions as indicated in the catalog. We believe them to be in foal, but are selling them as is and without return privileges, unless otherwise specified. 13. Sale of a horse is completed by the auctioneer and title passes when the horse leaves the sale ring. When a buyer settles in the sales office to clear paperwork and receive loadout slips, make sure the name, address, phone and AQHA information is filled out exactly as registration papers are to be transferred or office cannot be responsible for errors that may occur in transfer of ownership. 14. Title to and risk of loss passes to the buyer when the animal is knocked off as sold by the auctioneer. Immediately after the horse is sold, it will be the sole risk and responsibility of the buyer. Effective from the time of purchase, the buyer assumes responsibility for the maintenance and care of the animal. The buyer and sale attendees further agree to hold the consignor and Pitzer Ranch harmless from all loss, cost and expense arising from illness, injury or death of such animal, or loss or damage to property, and injury or death of persons, caused by themselves, their agents or employees, or by the animal, subsequent to the time of purchase.

15. Buyers and spectators are cautioned to be careful while on the grounds, particularly while horses are being shown or sold in the

16. Upon receiving payment for a horse, the cashier will issue an order to obtain delivery. Buyers are cautioned not to lose their receipts. Buyers must make arrangements for care of stock until it can be removed. Buyer will need to use the “ pink slip ” to be released to load. Do not remove hip numbers from horses once they are applied. Buyer releases will be checked against hip numbers and no horse will be released without a legible hip number.
17. Driver ’ s license will be required to obtain a buyer ’ s number. Payment terms for this sale are cash. Payment in full must be made
Traveler ’ s Checks, or approved bank check which has been verified and approved in advance by cashier and/or officers of Pitzer Ranch. All payments must be made to Pitzer Ranch. Any payment made by the buyer to the consignor or any other party will not be regarded as valid or entitle the buyer to delivery of the animal. No Re - Deposits: Anyone issuing us an insufficient fund check for a horse will run the risk of having their name printed in our mailing of 10,000 catalogs and flyers. The size of a NSF horse payment check classifies as a felony and it will be turned over to the District Attorney for immediate prosecution. All past buyers who have passed a “ returned check ” to the Pitzer Ranch will be required to pre - pay for their purchases or pay in cash. 18. All registration papers will be withheld until funds clear the bank. 14 days from the date of the sale the registration papers, along with transfer certificates, will be mailed directly to AQHA for transfer of ownership to the new buyer. Checks for payment will be mailed to the sellers on that same date. Disputes and returns between buyer and seller need to be completed by that date. 19. Buyers will pay the AQHA $40.00 transfer fee. All buyers will be charged the current rate of sales tax on any purchase, unless a tax number is given and the proper form is filled out at the office. You will be asked for your current AQHA membership number. Persons not having a current membership can either purchase one directly from AQHA or buy one at the time of payment for purchases.
20. Any horse not consigned to the sale and found on the grounds will be assessed a $200 fee and will go through the auction at the end of the sale. A release for this horse will not be issued until these terms are met. No horse will be let out the gate without a hip number and release issued through the office.
