We all know that wearing your seat belt is an important precaution to prevent injury or death in the event of an accident, yet, in some situations, people still forget or neglect to wear it. According to the National Highway Traffic Safety Administration (NHTSA), in 2017, seat belts saved roughly 15,000 lives across the U.S. In 2021, the national rate of usage for seat belts was estimated to be 90.4%. In Georgia, it is considered a violation to drive or have a passenger in the vehicle with you who isn’t wearing a seat belt. For children, if your child is 40 pounds or more, Georgia law says that they must be wearing a shoulder and lap belt. If the vehicle does not have both, they must at least have a lap belt or you risk a fine of $50. If you neglect to wear your seat belt, the fine is $15, but the offense will go on your driving record and, in turn, your insurance rates are sure to go through the roof.
The Georgia law is a little tricky when it comes to passengers. Front-seat passengers must always wear their seat belts, or the driver will be considered in violation of the seat belt law. Children who are 8–17 must wear a seat belt while riding in both the front and back seat. However, the driver is not responsible for adults in the back seat. It should be noted that there are a few exceptions to the seat belt law in Georgia. These include:

Driver has an official certificate or license issued by the proper agency in another country or state explaining they are not able to use a seat belt Vehicle is a model year of 1965 or older The passenger vehicle is not required to be equipped with seat belts according to federal law Vehicle is being operated by a U.S. Postal Service letter carrier in a rural area, is an emergency service vehicle, or used to deliver newspapers

Driver is frequently stopping and exiting or delivering property and not exceeding 15 mph Driver has a written statement from their doctor explaining that they are not medically or physically able to use a seat belt Driver is operating the vehicle in reverse
