Copy of Candidate’s Statements for Public Examination; Provisions to Amend or Delete Information Election Code Section 13313

Elections Code Section 13313 provides that the Elections Official shall allow a 10-calendar-day public examination period for candidate statements. During that 10- day-calendar period, any voter of the City or the City Clerk may seek a writ of mandate or an injunction requiring any or all of the material in a candidate’s statement to be amended or deleted. The writ of mandate request shall be filed no later than the end of the 10-calendar-day public examination period. The examination period begins immediately following the filing deadline for candidate statements. Translations/Cost to Print Included In compliance with provisions of the Voting Rights Act of 1965, and as amended, the City will translate all candidate statements into Chinese (including Taiwanese), Korean, Spanish, and Vietnamese for inclusion in the sample voter pamphlet. Registered voters may request copies of the pamphlets in any of the aforementioned languages from the Registrar of Voters. Each candidate filing a statement for publication will be required to pay the fee referenced on page 27 or $509.82 for the electronic- only option , in advance toward the total cost of printing, handling, translating and mailing the of candidate statements, including costs incurred as a result of complying with the Voting Rights Act of 1965 (as amended). THE CANDIDATE STATEMENT MUST BE FILED WHEN THE NOMINATION PAPER IS FILED IN THE OFFICE OF THE CITY CLERK. You must provide your prepared candidate statement in an electronic format and hard copy. The City Clerk will review your statement to ensure it is in proper form and complies with the word count standards. Following the City Clerk’s review, the final candidate statement will be printed for you at City Hall for your signature. The candidate must sign and date the statement before it is filed. Candidate statements may be withdrawn, but not changed, during the period for filing nomination papers ( December 23 – January 17 ), and until 5:30 p.m . of the next working day after the close of the nomination period which is January 20, 2025 (EC §13307(a)(3). Candidate statement are confidential documents during the nomination period and are not available for public review until after the expiration of the filing deadline. The candidate must sign and file a Candidate’s Statement Agreement if they choose to file a Candidate Statement, or a Candidate’s Statement Alternative Form if they choose not to file a Candidate’s Statement, included in the nomination packet. The candidate is required to pay the fee at the time the statement is filed. When the statement is filed, a copy of the signed statement and the signed fee agreement will be provided to the candidate.
