Use of Surplus Campaign Funds (Government Code § 89519)
After an election, a successful candidate may use leftover campaign funds for officeholder expenses or for a future election to the same office or to a different office so long as the funds are not considered “surplus funds” and the committee does not have “net debts outstanding.” The candidate must: File a new Form 501 ( Candidate Intention Statement ) , File an amendment to the Form 410 (Statement of Organization) “re- designate” a campaign committee. Open a new bank account A defeated candidate intending to run for the same office in a future election must re-designate the committee and bank account by filing Form 501 and an amendment to Form 410 before the end of the post-election reporting (no later than March 31, 2025). Refer to Chapter 4 of Campaign Manual 2. Failure by a defeated candidate to re-designate leftover campaign funds by March 31, 2025 will result in the funds becoming “surplus funds” that are subject to restrictions. Refer to Chapters 8, 9 and 11 of the Campaign Manual 2. Refer to Appendix E for campaign statement due dates. Note: Campaign funds become surplus on the 90 th day after the closing date for the postelection reporting period or upon the 90 th day after the date of leaving office, whichever occurs last.
