Jury Awards Over $7 Million
An Important Victory for Service Members Injured by Defective 3M Earplugs
The men and women who serve our country risk their lives to protect our freedoms, but they should not have to assume unnecessary risk of injury due to faulty protective equipment. Earlier this year, a jury found that 3M’s defectively designed earplugs had caused undue injury to service members. The jury awarded $7,130,500 in damages, including $2.1 million in punitive damages to each of the plaintiffs. These punitive damages are especially notable, as they serve specifically to punish a wrongdoer, a penalty in excess of the actual harm caused by the severity of 3M’s conduct. The jury’s unanimous verdict was delivered on April 30, 2021, after hearing the service members’ common-sense argument: that their military branches relied on 3M’s promises and that in the course of their duties, service members used the earplugs as directed. The jury ultimately rebuffed 3M’s argument that military and service members had themselves caused the injuries and concluded that 3M had injured each of the service member plaintiffs through its
defectively designed earplugs, falsified data, and failure to provide their contractually promised ear protection.
The three service members awarded damages this spring are just the first wave of plaintiffs arguing that 3M knowingly provided them defective gear. More than 200,000 service members have filed lawsuits seeking justice for the hearing loss and tinnitus that they suffered when the earplugs failed to perform as promised. Notably, hearing loss is the leading disability resulting from service. These three service members have won the first victory, and the court has calendared two additional trials in short order, continuing this campaign for service member justice for the nearly 240,000 remaining victims of 3M earplug failures. 1. First, make the dressing. In a jar, add soy sauce, sesame oil, orange juice, and ginger. Secure the lid and shake until emulsified. 2. In a small bowl, empty the drained tuna and pour the dressing over top. Add the cilantro and scallions and stir until well coated. 3. Divide rice between two serving bowls. Top with the dressed tuna, avocado, tomatoes, and sesame seeds.
