It seems like the number of red-light cameras is always increasing. In Bakersfield, CA, alone, they pop up at intersections consistently. If you receive a red-light violation in the mail, then it’s crucial to understand the penalties and possible defenses you could use to dispute the ticket. Luckily, we’re here to lay out all the necessary information you need if this ever happens to you! THE FINES GO FROM “HIGH” TO “HIGHER” A first-time red-light camera ticket will cost you close to $500. However, a second ticket within a few years will cost almost $900! Additionally, you’ll be assessed a point on your license for violations in a personal vehicle and 1.5 points if you were in a commercial vehicle. IS THERE A WAY TO DISPUTE A CAMERA-ENFORCED RED-LIGHT TICKET? Contrary to what you might think, these tickets are not indefensible! Here are a few potential defenses that could help. • Unclear driver identity: Did you know the vehicle owner doesn’t have to prove they were not driving at the time of the violation? The burden of proof is on the state to prove who was behind the wheel! Additionally, you don’t have to reveal who was driving. • Equipment malfunction: If there is a reason to believe the red-light camera was faulty at the time of the violation, it can be used to resolve your case. • Premature light change: While the CA Manual on Uniform Traffic Control Devices declares the duration of yellow lights depending on the speed limit of the street, you could still argue the light changed to red too quickly. • No warning signs posted: CA law requires a sign notifying you of the red-light camera before the intersection.
