Clyde Co Guide to Superyacht Law - Sixth Edition

FLYBOARDS

The flyboard is a relatively recent invention which has risen in popularity, but, as with other water toys, presents potential health and safety risks. If you will be using a flyboard from your superyacht, we would recommend equipment is used and managed under a safe set of operating procedures with a certified instructor, which may be a trained crew member.

As a duty of care is imposed on the user, proper care and attention should be given when using the flyboard. It is worth checking whether its use is covered under any of your insurance policies as water sports equipment, or whether specialist insurance is required. We further recommend having suitable indemnities in place for guests to sign prior to using the flyboard, whether or not the superyacht is chartered or used privately.

It is important to check whether the flyboard can be used in the relevant jurisdiction and whether any licence must be granted for its use; such a licence may impose safe operating conditions including restrictions for usage in certain weather conditions and regarding the wearing of protective helmets. You should also consider any age/weight requirements imposed on the flyboard user. The flyboard is typically powered by a jet ski, so it is also essential to ensure that you consider local laws relating to jet skis.
