type of housing need in Fuquay-Varina, the inclusion of this type of development will further serve the public health, safety and welfare of the citizens of the Town.

ii. Intent . A townhouse development shall be designed and constructed in a series or group of attached units with the property line being the common wall separating each unit. iii. Applicability . The legal basis for a townhouse development shall be the applicable North Carolina General Statutes, the North Carolina State Building Code, the Fuquay-Varina Land Development Ordinance, and any adopted documents, as amended. iv. Density . The residential density for a townhouse development shall be no greater than permitted by the applicable zoning district in which the townhouse development is located and permitted. v. Public Utilities Required . Townhouse developments are required to connect to Town public water and sewer utilities. The water and sewer utilities within the townhouse development may be private lines which connect to the Town's public utilities. The Town will determine whether public or private utilities will be required within the townhouse development and determine what instruments need to be executed. vi. Street Access . Townhouse developments may include street access by public or private right-of-way (streets and alleys). Where provided, private right-of-way (streets) shall conform to the Town’s Standard Specifications & Construction Details, as amended. Lots with rear alley access may front onto common open space as long as pedestrian circulation is provided to the front of the buildings.

1. Front Setback

I. Public Right-of-Way. Minimum 30 feet, or a minimum of 20 feet when fronting on a public right-of- way identified as a “Type 6” street or smaller, in accordance with the Town's Standard Specifications & Construction Details, except in the Town Center Residential (TCR) Zoning District, Planned Unit Development (PUD) and the Downtown Center-2 (DC-2) Zoning District where
