Land Development Ordinance - Amended 4-2-2024

Community Pedestrian Master Plan, which shall include striped crossings at designated locations and at all thoroughfares with a right-of-way of 60 feet or greater. The following thoroughfares are exempt from standard thoroughfare improvements but shall be required to provide dedication of right-of-way and/or improvements as indicated:

a. US 401 (N Main Street / Fayetteville Road): Right-of-way dedication only from NC 42 Hwy / S NC 55 Hwy to Ten-Ten Road (SR 1010).

b. NC 55 Hwy (N Broad Street): Right-of-way dedication only from Wade Nash Road / Dickens Road to urban service area boundary.

c. Fuquay-Varina Parkway: Right-of-way dedication and construction of outer two (2) lanes with outside curb and gutter, pedestrian improvements and grassed median (depressed) and necessary drainage.

d. SE / SW Judd Parkway: 100-foot right-of-way dedication and construction of a three (3) lane cross-section.

e. NC 42 Hwy (W Academy Street): Right-of-way dedication only from Piney Grove Wilbon Road west to urban service area boundary.

f. NC 42 Hwy: Right-of-way dedication only from Old Stage Road east to Mt. Pleasant Road/urban service area boundary.

g. Infill Subdivisions . Subdivisions proposing no more than 24 lots of single-family detached infill development, as defined in Article S Interpretations & Definitions, §9-1901, may be exempt from required right-of-way improvements along the subdivision frontage. The dedication of the required frontage right-of-way width as designated by the Community Transportation Plan shall be required.

§9-1609 THOROUGHFARE CONSTRUCTION

A proposed thoroughfare widening or new construction shall require dedication of right-of-way(s) along existing or proposed thoroughfare(s), as defined in the Community Transportation Plan (CTP), and shall be constructed to the Town’s Standard Specificatio ns & Construction Details, except as provided in Article Q Procedures & Administration, §9-1808, z. Site Plan, (7), G. of the Land Development Ordinance. Where a proposed thoroughfare is on the Community Transportation Plan (CTP) and such thoroughfare is not required to be constructed in accordance with the Land Development Ordinance, the dedication or reservation of right-of-way shall be required for any subdivision, site plan or other
