§9-1615 PUBLIC UTILITIES

Developments, including subdivision and site development for both residential and nonresidential uses, shall connect to public utilities in compliance with the provisions of this Section. Public utilities include public wastewater (sewer) and public water.

a. Connection within Corporate Limits

Developments within the corporate limits of the Town of Fuquay-Varina shall connect to the Town’s public utility systems, unless it is determined by the Town that one (1) or both public utilities are not available to serve the site. A single-family home not developing as a result of a subdivision shall be exempt from the requirement to connect to public utilities.

Additionally, the Town may mandate that the subdivision shall connect to public utilities if one (1) or more of the following apply:

(1) The private drinking water well serving the property has failed and cannot be repaired, as determined by Wake County;

(2) The property is located in an area where the drinking water removed by the private drinking water well is contaminated of likely to become contaminated due to nearby contamination, as determined by the local health department;

(3) The Local Government Commission (LGC) is assisting the government utility operating the public water system.

b. Connection within Extraterritorial Jurisdiction & Urban Service Area

Developments within the Town of Fuquay-Varina ’s extraterritorial jurisdiction (ETJ) and Urban Service Area (USA) shall connect to one (1) or both public utilities where any portion of the property included in such development are within the distances provided herein. This connection distance applies independently to water and wastewater systems. A single-family home not being developed as a result of a subdivision shall be exempt from the requirement to connect to public utilities. (1) Residential Development . Connection shall be made to public water where located within 50 feet per dwelling unit, provided that the maximum required connection distance is 2,500 feet, as measured along the probable route of the service line. The number of dwelling units proposed shall include the total number of units permitted and shall include units in all phases of a phased development.
