b. New Development
The parking and loading standards of this Article shall apply to the erection of any building, improvement of land and to any new use established within the corporate limits and extraterritorial jurisdiction (ETJ) of the Town of Fuquay-Varina or as otherwise provided or restricted in this Article.
c. Expansions & Modifications
The parking and loading standards of this Article shall apply when an existing structure is expanded or enlarged. The additional parking and loading area shall apply only to the expanded or enlarged portion of the existing structure. (1) Exception . Any structure or use in existence on the effective date of the Land Development Ordinance (December 30, 2016) shall not be affected by the standards herein except as follows: A. 10,000 sq. ft. or Less . Where the existing gross floor area of a structure is 10,000 square feet or less and the expansion or enlargement is increased by 25% or more, then the new square footage of the expansion or enlargement shall meet the additional parking and loading standards of this Article. B. Greater than 10,000 sq. ft . Where the existing gross floor area is greater than 10,000 square feet and the expansion or enlargement is increased by 10% or more, then the new square footage of the expansion or enlargement shall meet the additional parking and loading standards of this Article. (2) Minimum Percentage . In all cases, the number of parking and loading areas provided for the entire use (pre-existing plus the expansion or enlargement) must equal at least 75% of the minimum ratio established in this Article to provide the minimum number of parking bays required for a use.
d. Change of Use
Parking and/or loading bays shall be provided with any change of use, based on the minimum parking standards in this Article, except as otherwise provided by the Land Development Ordinance. Any new parking or loading areas shall meet all minimum requirements of this Article, unless otherwise stated.
