obtain approval, construct thoroughfare improvements and dedicate required right-of-way.

A. Where a project is adjacent to a federal or North Carolina State Highway identified on the North Carolina State Transportation Improvement Program (STIP) and is scheduled to be under construction within five (5) years from the date of the project approval, approval of the project shall not require thoroughfare improvements, provided the property owner/developer provides a payment-in-lieu for improvements, in accordance with the Town Code of Ordinances, Part 9 Land Development Ordinance, Article J Subdivision Regulations, §9-1466; or B. Impact by STIP Project. Where a project is not adjacent to a thoroughfare identified as a federal or North Carolina State Highway not on the State Transportation Improvement Program (STIP), but may be impacted by the STIP within five (5) years of approval of the project, the Town Board of Commissioners may consider not requiring that improvements be provided by the property owner/developer, but instead require a payment-in-lieu for improvements, in accordance with the Town Code of Ordinances, Part 9 Land Development Ordinance, Article J Subdivision Regulations, §9-1466.
(10) Proportionality.
A. Construction Exemption. Where a project is subject to thoroughfare improvements in which the total cost of the thoroughfare improvements will exceed 35% of the site work costs, the Town Board of Commissioners may consider not requiring the thoroughfare improvements be provided by the property owner/developer, but instead require cost estimates for both the required thoroughfare improvements and proposed site work costs to be submitted and approved by the Engineering Director justifying the exemption. Right-of-way dedication is still required, if applicable. B. Dedication Exemption. Where a project is subject to thoroughfare improvements in which the required right-of-way dedication will exceed 35% of the parcel area or will create noneconomic remnants of more than 35% of the parcel area, the Town Board of Commissioners may consider not requiring the dedication or construction of thoroughfare improvements be provided by the property owner/developer.
