Carolina Department of Transportation maintained thoroughfares. The Director of Engineering will further coordinate with the North Carolina Department of Transportation regarding any requirements that may apply.

(4) Comments . The Director of Engineering shall forward any comments by the Town of Fuquay-Varina to the property owner/developer of the proposed development and to the consultant that prepared the traffic impact analysis.

jj. Utility Request & Allocation

The Town of Fuquay-Varina is responsible for managing the availability of capacity for public water and wastewater to ensure adequate supplies for all citizens and businesses within the corporate limits. The ability to manage the capacity of public water and wastewater requires that a property owner/developer submit a request for public utilities by submitting a completed utility allocation request form that is provided by the Public Utilities Department. A request for utilities shall be in accordance with the following procedure: (1) Contact Public Utilities Department . The property owner/developer will contact the Public Utilities Department to discuss the need for a utility allocation. As a result of this contact, it may be necessary for the property owner/developer and the Public Utilities Department to schedule a meeting to discuss such request. Additional Town staff may also be requested to attend the meeting. (2) Submit Utility Allocation Request . The property owner/developer shall complete the utility allocation request form and submit the form to the Public Utilities Department for evaluation and recommendation. (3) Approval . If the allocation request is less than 10,000 gallons, the Public Utilities Director may approve the allocation request administratively. However, if the allocation is greater than 10,000 gallons, the allocation request shall be submitted to the Town Board of Commissioners for approval.

Variances are adjustments from the required standards of the Land Development Ordinance in a specific zoning district when a property owner proposes to demonstrates that special circumstances or conditions, beyond the property owner’s control (i.e. topographical conditions, narrowness, shallowness, or the shape of a specific property), and the literal enforcement of the provisions of the Land Development Ordinance would
