The Watershed Protection Overlay (WPO) Zoning District is intended to ensure that quality of the public water supplies for the Town of Fuquay-Varina are preserved and maintained for present and future citizens of the Town of Fuquay-Varina and extraterritorial jurisdiction. The protection of the water supply system is maintained through the application of land-use controls and water quality performance standards for development within each Watershed Protection Overlay (WPO) Zoning District in accordance with Article I Environmental Protection Standards of the Land Development Ordinance.
b. Highway Corridor Overlay (HCO) Zoning District
(1) Purpose and Intent . The Highway Corridor Overlay (HCO) Zoning District is intended to encourage and enhance vibrant commercial corridors immediately adjacent to significant highways throughout town while protecting the transportation capacity of these roadways through controlled access points. The HCO accommodates a wide range of commercial uses, while restricting future residential subdivisions and assembly uses that are incompatible with the economic and transportation roles of these corridors and may create conflicts due to the differing intensity of those uses. The HCO also facilitates high-quality development and redevelopment of commercial and office districts through creative and efficient site design and facilitates the efficient provision and use of public utilities and infrastructure. (2) Applicability . The Highway Corridor Overlay Zoning District is an overlay zone, wherein all land use regulations applicable to the underlying zone remain in full force and effect except where superseded herein. Where the underlying zone does not provide a standard, or where a provision of the overlay is in conflict with the underlying zone, the overlay ordinance requirements shall apply. Uses existing, approved, or those developments that have submitted a complete development application package for review prior to July 11, 2022, shall follow the requirements of Article K, Nonconformities. (3) Locational Criteria . The Highway Corridor Overlay Zoning District shall apply to all parcels directly adjacent to the right of way on the following segments of roadways located within the Town’s zoning jurisdiction, as shown on the official Zoning Map. In cases where any portion of a building or developed site falls within the boundaries of the overlay district, these provisions shall apply to the entire site.
