(3) Balconies and bay windows may encroach into the first lot layer 25% of its depth except that balconies on porch roofs may encroach as does the porch (See Table – Residential Mixed-Use (RMU) Standards).
c. Specific to Commercial Mixed-Use (CMU) District (See Table – Commercial Mixed- Use (CMU) Standards).
(1) Balconies, open porches, bay windows and stoops may encroach into the first lot layer 80% of its depth.
(2) Awnings may encroach over the sidewalk to within two (2) feet of the curb but must clear the sidewalk vertically by at least eight (8) feet.
(3) In the CMU Zoning District, a maximum of 10% of the non-residential space may be amenitized pedestrian space such as plazas, outdoor dining, and pocket parks, according to the following standards:
A. less than one-half (1/2) an acre;
B. an accessory to a non-residential use;
C. activated appropriately for the primary use it is associated with (i.e. outdoor dining for a restaurant or café);
D. the areas are not already included in the required civic space for the rest of the site;
d. Specific to Employment Mixed-Use (EMU) District (See Table – Employment Mixed Use Standards).
(1) Awnings and galleries may encroach over the sidewalk to within two (2) feet of the curb but must clear the sidewalk vertically by at least eight (8) feet.
(2) Stoops, light wells, balconies, bay windows, and terraces may encroach the first lot layer 100% of its depth.
