FIGHTING FOR YOUR RIGHTS

What to DoWhen Your Car Is Towed After an Arrest?

When you’re arrested, it’s important to remember that even if you broke the law, you have rights, and the state has to honor those rights. Along with personal privileges to a fair and speedy trial, you have the right to your vehicle after an arrest. In Georgia, a law enforcement officers can impound a vehicle when the driver “is arrested for an alleged offense for which the officer is required by law to take the person arrested before a proper magistrate ...” This arrest could be for a DUI, fatal accident, or other serious crime. However, law enforcement must comply when the licensed driver and owner of the vehicle requests its release. If you’re arrested and jailed, you can authorize someone else to pick up your vehicle for you. Regardless, obtaining your vehicle as soon as possible will help you avoid exorbitant fees. In both scenarios, the person requesting the vehicle’s release needs to present verifying documentation, and the required documents vary depending on who is requesting the release. If you’re a licensed driver and owner, you need the following documents: • Title or valid registration of the vehicle • The bill of sale if the car was purchased 25 days prior to being impounded • Proof of valid insurance and state identification

If you’re requesting a release on someone else’s behalf, you need the following documents: • A notarized power of attorney • A letter from the legal owner giving the person with the power of attorney permission to recover the vehicle. This letter should also include the make, model, and VIN of the vehicle, as well as the name and contact information of the vehicle’s owner. Law enforcement may deny the release of the vehicle if it is part of an ongoing investigation. However, if you provide the proper information needed for the vehicle’s release from a legal impoundment, you will only have to pay the towing and storage fees from up until the time you sent in the request for the car. After that point, the agency that refused the release will be liable for the remaining storage fees. Hiring an attorney to file a motion for the release of your vehicle as quickly as possible will reduce the amount of fees you owe. Don’t fight your case alone.
