Notice of Violation

l An NOV is the most formal type of enforcement action. It is appropriate for: u A serious regulatory or statutory violation; u Non-response to PNOV or less formal enforcement mechanisms; or u Repeated violations of the same type.

Appropriate Use of NOV

l The violation is serious, repeated and/or continuing in spite of previous informal actions. l The violation appears to present an imminent and substantial hazard to human health or the environment or the property and assets of the Tribe. l Suspected significant violations of prior administrative orders l Failure to report violations when required by law. l Failure to pay civil charges. l Failure to take timely and appropriate required action.
