BEIS consult on Parental Bereavement Pay and Leave 6 April 2018
The Labour Market Directorate within Department for Business, Energy and Industrial Strategy have launched a consultation to gather views and opinions on the delivery of Parental Bereavement Pay and Leave.
Kevin Hollinrake MP’s Parental Bereavement (Leave and Pay) Bill, if it is approved by Parliament, will create a statutory right to time off work for employed parents, with pay where eligibility requirements are met, following the loss of a child. It is the aim of Government to be prepared to implement the necessary regulations to set out the detail of these rights and bring them into force and as part of that preparation this consultation will run until 8 June 2018. Its publication follows the successful passage, so far, of the Parental Bereavement Bill though parliament. It seeks views from stakeholders on options that will be contained within the Regulations that will fulfil certain provisions contained in the Parental Bereavement (Leave and Pay) Bill, in the event this is passed by Parliament and becomes law.
The consultation will focus on several key areas of detail including:
• The definition of a ‘bereaved parent’ • how and when to take Parental Bereavement Leave and Pay • notice periods for Parental Bereavement Leave and Pay • evidence of an employee’s right to take Parental Bereavement Leave and Pay
The Bill provides for a minimum of 2 weeks of leave to be available to all employed parents who lose a child under the age of 18 and if passed and once it has been brought into force, parents will be entitled to this leave irrespective of their length of service with their employer and the entitlement will apply in respect of each child. Pay will be subject to qualifying conditions as found with other similar periods of statutory pay aimed at the working parent.
This does not prevent or prohibit employers going beyond that and providing more generous allowances.
Geographical extent: The Parental Bereavement Leave and Pay measures will apply to Great Britain only.
