Non-compliance with auto enrolment has further consequences 26 April 2018
Not only did bus company Stotts Tours and its MD receive a criminal conviction for failure to comply with automatic enrolment legislation, the company now also faces the possibility of losing its operating licence due to loss of good repute.
Professional Pensions (PP) has reported that the Office of the Traffic Commissioner (OTC) has called a public inquiry to deliberate whether the bus company retains "good repute" as required under operating licence rules.
In November last year TPR secured its first wilful non-compliance conviction as Stott Tours was found to have deliberated failed to put 36 members of staff into a workplace pension and begun to pay contributions from June 2015.
According to PP the inquiry will be held on 27 April in Golborne, Wigan and will include evidence from independent third parties - government and enforcement agencies, such as the Driver and Vehicle Standards Agency (DVSA) - as well as the bus company and investigators.
Reportedly the OTC could decide to curtail, suspend or revoke Stotts Tour's licence, as well as disqualify businesses and individuals from operating in the future. A decision will be made either on the day or within 28 days of the hearing.

Changes to government gateway for Declaration of Compliance 2 May 2018
From 14 April 2018 The Pensions Regulator stopped using the government gateway as the authentication process for the Declaration of Compliance portal.
Instead, employers and advisers will log in to the portal via TPR’s own system. To ensure that the changes are user- friendly, a series of testing and research has been conducted over the past year.
The key changes to note to the new ‘AE Login’ are: • The landing page includes a guidance box ‘We’ve made some changes’ in order to help employers know what they need to • Employers will require a passcode, which is easily obtained by creating an account from the main landing page • Helpful warning/reminder messages will appear in red if an employer is close to their duties start date, in order to prompt employers to complete their declaration of compliance • Those who are completing Declarations of Compliance for multiple employers will be able to view the progress for each on a ‘multi-employer dashboard’. This includes the option to search for employers and sort by declaration deadline What if a Declaration of Compliance has already been partially completed through government gateway? All previous progress completed through government gateway will have automatically been saved. Once a new account/passcode is created, an employer will be able to access their partially-completed declaration and carry on from where they left off.
