sentence suspended for two years, a five-month overnight curfew and was ordered to pay £1,500 costs. Neal was given a two-month prison sentence suspended for two years and was ordered to do 200 hours of community service and to pay £1,500 costs. West, Tomlinson and Thorpe were each given a two year community order and were ordered to do 150 hours of community service and to pay £500 costs.
Darren Ryder, TPR’s Director of Automatic Enrolment, said:
“The scale of the punishments handed down today shows the court agreed with us that these were very serious offences.
“Automatic enrolment has led to almost 10 million more people saving towards their retirement. Its success cannot be allowed to be undermined by such incredibly rare cases of unacceptable behaviour as that of Workchain.
“NEST’s vigilance, our thorough investigation and the sentences from the court have led to a clear message - employers cannot opt a worker out of a pension scheme, even if the worker agrees. Those who try to avoid their pension responsibilities in this way face receiving heavy fines and criminal records.”
Every employer in the UK has a number of workplace pension duties. Once an employer has set up a pension scheme and put eligible staff into it, their duties don’t end there. It’s important that employers get to know their ongoing duties –
TPR will take action if they fail to comply.

The Pension Regulator (TPR) unveils newlook website 20 November 2018
TPR have launched a new website, Liz Hickey, director of communications at TPR, said: “Our new website delivers major improvements to the hundreds of thousands of people who visit it every month, from employers and trustees to pension savers.”
In 2007/8, 149,604 people made one million visits and looked at over two million pages. In 2017/18, 3.4 million people made 6.1 million visits and looked at over 39 million pages on the website.
The new look brings the design up to date with government digital standards and provides a more consistent experience with the .gov websites. TPR believe the new site highlights how the organisation is changing its approach to become “clearer, quicker and tougher. The site rebuild should mean a “clearer and simpler experience” and help cope with the increase in people using the site following the introduction of auto enrolment and the Pensions Freedoms. The audiences that use the website are not only employers but also trustees, administrators, savers and the wider public. It is used as a source of information and for guidance. TPR have assured the website will continue to be developed to further improve the content and provide even better support to key audiences.
