Calculating holiday pay for workers without fixed hours or pay 27 February 2019

The Department for Business, Energy and Industrial Strategy (BEIS) has published additional guidance on how to calculate holiday pay for workers whose hours and / or pay are not fixed.

The new guidance ‘Calculating holiday pay for workers without fixed hours or pay’ explains how to calculate statutory holiday pay for workers without fixed hours or fixed rates of pay. It has been designed as a practical guide for employers with sections designed to respond to specific questions employers may have when calculating holiday pay for individuals who are working without fixed hours or fixed rates of pay.

It complements the Holiday entitlement: the basics guidance, which explains how to calculate holiday pay for the majority of workers.

Both employers and workers can use this guidance.

CIPP comment The Policy team have been in discussions with BEIS, stakeholders and members for quite some time now to bring together more comprehensive guidance on the subject of calculating holiday pay. The Employment Rights (Increase of Limits) Order 2019 4 March 2019

This order increases, from 6 April 2019, the limits applying to certain awards of employment tribunals, and other amounts payable under employment legislation, such as redundancy payments and unfair dismissal awards.
