Hope you had a great summer! July and August had quite a bit of activity even though our summers are generally more on the quiet side. We continue to make our presence known and continuously create positive opportunities as we are powered by some amazing members! We have another carefully crafted and spectacular issue of OnSite filled with the best of the best! Congratulations to Michele Leppard, our amazing Executive Officer! Michele attended the Association Management Conference of the National Association of Home Builders (NAHB) in Utah and was awarded the National Award for Small Office Honor Executive Officer of 2023! This is a special award to truly the best Executive Officer! Thank you for all you do, Michele! We had the pleasure of interviewing Bill Psolka of Psolka Photography. By Jason Bonura, President, Cedars Contracting Group Cedars Contractors Group is are proud to have partnered with the Metropolitan Builders Association to give back to the ECLC of New Jersey, a nonprofit organization dedicated to educating students with severe learning and language disabilities, autism spectrum disorder, Down syndrome, and multiple disabilities. Our team at Cedar organized a volunteer event to paint the facilities, enhancing their learning environment and improving their space. This event aimed to provide a

supportive and stimulating atmosphere, bridging the gap between the classroom and adulthood. We’re grateful to the Metropolitan Builders Association for hosting this event and thank Christina Klimkowski and Heather Alonge for their help in coordinating it. Thank you to our team members who rolled up their sleeves to make a difference! We’re thrilled to have helped improve the learning environment at ECLC of New Jersey. How Did you get into the Business? Sphere Construction started in 1986. We are a General Contractor. How did you get involved in Metro? My father, Henry Vitiello, was a long time Metro Member

Why did you join Metro? To give back to the Industry that has been so important to me. I give praise to all those people with the foresight and courage who have made that decision to build. Look around. Every building you see started out as someone’s idea. We turn ideas and dreams into reality. As a professional with an extensive background in the construction industry, I have molded a construction staff qualified in estimating, project management, construction management, scheduling, and a competent field staff of experienced superintendents. Tell us something about what motivates you. My work ethics and commitment to family and church comes from my family, especially my grandfather Thomas. He was a 1st generation immigrant from Italy who settled in Newark NJ . He found blue collar work as a day laborer working for

the railroad, after a few years he became a landscaper. As a child I remember our backyard had this enormous garden, where grandpa grew tomatoes the size of grapefruits! My father Henry graduated from Barringer High School in Newark. After graduation Henry enrolled in the Vale School of Business and graduated from Vale in 1948. Henry then began his lifelong career as a salesman for building supply companies. His first job was at Newark Lumber Company selling nails. Henry then worked selling roofing and siding materials for the Roth brothers Al & Joel at Arzee Supply. Henry continued his sales career at Allied Building Products up until his death in 1990. How would you guide others? To be an example of honesty and integrity. It is also important to focus on the customer experience. The relationship with our clients has thrived as we enhance our tradition of teamwork, accountability, and innovation. Our proven Design/Build

experience as well as a critical eye toward value engineering has given Sphere Construction Group LLC the edge for completing the project under budget and ahead of schedule. Our goal is to see that customers utilize and enjoy their new building, addition, or alteration as they had envisioned they would. Feelings behind members helping members? Truly supportive of this. Years in this business: 20 How did you get into this business? I originally went to school for illustration. In our foundation year we had to take a whole range of subjects including painting, sculpture, photography, filmmaking, etc. I fell in

variations. This is why I work with clients to figure out a concise shot list of the best aspects of the project we want to capture. Then I scout the project remotely or in person to figure the best times of day for particular angles. Working with an assistant, we then compose and light interiors as well as some exteriors to highlight their best qualities. There is also some post production work done to bring the images to a higher standard. My primary directive is to accomplish the best work possible that puts the client in a position of elevating their marketing, portfolio, and publishing materials. This is done in collaboration with the client to their level of comfort. Some clients like to be very involved and some like a more hands off approach. I’m comfortable with either as long as there is clear communication and coordination. This relates to “comfort” for me. We all have enough stress in our lives and none of us need any more. Successful client relationships need to have a certain comfort level and I like to keep that level as high as possible for us both, by being very approachable and flexible where possible. Over the years I’ve found the best results are achieved when all three of these – quality, collaboration and comfort – are present. The best advice I ever got was from my dad, Thomas A. Psolka, who was a jazz guitarist. He always told me “there’s no last lesson.” I’ve found this to be true in most all aspects of life and it inspires me to keep learning and honing my craft as well as learning on a broader level. Worst advice you were given? Did you realize immediately or did you follow it and then find out? Best/Favorite Mentor? I’ve had several mentors in my career starting with my high school art teacher Mr.

love with photography, however, I never thought I’d end up photographing buildings until at one point someone asked me to. That’s when I realized how challenging and creative it could be. What products and services does your company provide? I provide beautiful photography of clients’ projects for their marketing, portfolio, websites and publication. What differentiates you from others in your industry? My philosophy is based on quality, collaboration and comfort. Firstly, I believe in quality over quantity. I studied photography at The Cooper Union and was pushed to achieve creative excellence, which has been my guiding principle. There are many photographers taking a “shotgun” approach, taking as many images as possible as they walk through a property. I don’t believe this is the best way to capture the character of a project. In fact, I’ve had clients hire me to re-shoot projects they had photographed this way. To me it seems that if you’re creating photographs that are going to be part of your marketing and portfolio for a while, you want to get the best quality images and not 100 mediocre

Michnowicz who encouraged me to apply to The Cooper Union where I was accepted. Norman McGrath, whose definitive book on the subject I cherished and whose workshop I amended. And the many great photographers associated with the ASMP (American Society of Media Photographers), including my good friend and fellow photographer Mark Lamkin. Why did you join Metro? I’ve thought about joining for a couple years, and finally decided to take the plunge. What are you looking forward to at the 2025 AOEs? I’m looking most forward to continuing to meet and nurture relationships with other members. What are you listening to? I’m currently listening to Sierra Ferrell. I just discovered her and have her on autoplay. I also recently discovered Colter Wall. Next month it may be Frank Sinatra and Stevie Wonder…? What are you reading? The War of Art by Steven Pressfield How do you relax and disconnect? My two favorite ways of relaxing are movies and playing guitar. I am a bit of a movie buff and love the classic movies and photography of the golden Age of Hollywood. Movies are always a good way to disconnect for me, whether classic or modern. Music is also a big part of my life. In fact it was difficult to choose between the visual arts and music. I got my love

of music from my dad and I actually thought about going to music school early on. I’ve been playing in bands since high school and still play in a gospel band at my church. It supplies an endless well of challenge and creativity. Favorite Color? My two favorite colors are blue and orange, which is interesting since they are complimentary on the color wheel. My wife, who’s a graphic designer, tells me that blue connotes stability and orange enthusiasm, so I’ll go with that. Favorite Food? It’s definitely changed over the years, and I’m not a very adventurous eater, but right now I’d have to say Tacos. Favorite Band? Needtobreathe has been my favorite band for a while now. I find the positivity of their music along with some southern influence and great writing to be very inspirational. Favorite Trip/Vacation: My wife and I took a trip a number of years ago to Oregon. Just three weeks driving around the state of Oregon. That still lives in my mind as the best vacation we ever had. Another favorite is the classic, Niagara Falls. Everyone should go there at least once. Any Favorite Project you have worked on: One of my favorite projects was photographing interiors at the NYC Federal Reserve. Wish I could say more, but it’s the Federal Reserve.

Thereafter, on August 21, 2022, the Texas court issued an Opinion and Order granting summary judgment in favor of the plaintiffs and setting aside the FTC Rule banning non-compete agreements. The Court concluded that the FTC exceeded its statutory authority by issuing such a sweeping, substantive rule, and that the rule itself was arbitrary and capricious. This means that the FTC Rule will not be enforced and will not take effect on September 4, or thereafter. The FTC has indicated that it is considering an appeal, and in a case pending in the Eastern District of Pennsylvania, that court has signaled that it may reach the opposite conclusion. Therefore, the viability of the FTC Rule could make its way to the Supreme Court, but it is not enforceable in the interim. * * * * * * * * Each issue’s Saiber Construction Law Column will discuss a recent decision by New Jersey courts or, like here, courts from other states which may be of interest to people in the construction industry. FTC NONCOMPETE RULE STRUCK DOWN BY TX FEDERAL COURT

For years, many employment agreements contained non-compete provisions – terms in an employment contract that generally restrict the employee’s right to work after the employee’s employment ends to prevent the employee from competing with his/her employer. In New Jersey, there are no statutes or regulations governing non- competes, but cases decided by courts have held that non-competes are enforceable when they are reasonable. Courts typically look at the facts of the matter before them and then decide if a particular non-compete provision’s restrictions as to time, geography and scope are reasonable. But, all of the above may change soon! On April 23, 2024, the Federal Trade Commission announced its Final Non-Compete Rule, which bans certain post-employment non-compete clauses between employers and their workers. The FTC’s Rule is scheduled to take effect on September 4, 2024. The Rule essentially declares it an unfair method of competition for parties to enter into non-compete clauses on or after the Rule’s effective date. With regard to non- competes entered into prior to September 4, 2024, the FTC Rule allows non-competes with senior executives (workers in a policy-making position who received at least $151,164 as total compensation in the preceding year( in the to remain in place but declares non-competes with other employees unenforceable. Employers are also required under the Rule to notify workers with existing non-competes that their non-competes are no longer enforceable after September 4, 2024. In addition, the Rule pre-empts any state laws that conflict with the FTC’s Final Rule. Not surprisingly, the legality of the FTC’s non- compete Rule has already been challenged. In Ryan LLC v. FTC, the plaintiff filed suit in federal court in Texas to enjoin the FTC from enforcing the Rule, arguing that the FTC lacked the authority to enforce the Rule and went beyond the scope of its authority to enact the Rule in the first place. On July 3, 2024, the judge preliminarily enjoined enforcement of the Rule, agreeing that plaintiff would likely succeed in demonstrating that the FTC exceeded its statutory authority to make the Rule. The judge also agreed that plaintiff would likely succeed in showing that the Rule was overbroad, arbitrary and capricious. However, the judge specifically limited the scope of her decision to only the parties to the Texas litigation.

2024. It is an occasion to celebrate women as an important component of the residential construction industry. Showcasing the achievements of women across all facets of the industry and the efforts to promote, train, advance and add more women in the field. Each day highlights a different focus featuring women and accomplishments in the industry. Here are some of the latest figures about women in our industry, both good and bad: • 10.9% of women in the US are in construction (~1,173,000), up from 9% in 2021. • 1.25% of the total workforce in the construction industry are women, despite the fact the 47% of the total workforce of employed individuals are women. • 13% of all construction companies worldwide are owned by women; 9% make more than $500,000 annually. • 30% of women in construction/trades earn 30% more than those working in other women-dominated occupations. • 25% of construction companies that employ women achieve above-average profitability compared to firms without women. • 8 out of every 10 women feel left out during construction companies’ social events! To celebrate many of these accomplishments and continued movement forward women in our industry, Metro’s 2023 Small Council of the Year Award Winning PWB Council, will be hosting the September 19th Metro General Membership Meeting. It will be held and sponsored by General Plumbing Supply (GPS) at their new Kohler Signature Store at 407 Springfield Avenue in Summit from 5:00 to 8:00 PM. We are trying something different this year; it will be an “OktoberFest” with all the food and fixings to celebrate the season!
