New Guardianship Law in Nevada PLANNING AHEAD Estate Planning | Probate | Guardianships for Your Life Chapters

The Nevada legislature has completed its 2025 session. Effective Oct. 1, 2025, there are new rules governing guardianship in Nevada. The Senate passed Senate Bill 346, which requires that the least restrictive alternatives to guardianship must be considered before the Court will establish a guardianship. The guardianship court must consider whether a durable power of attorney for health care, a durable power of attorney for assets, or a supported decision- making agreement can meet the needs of the proposed protected person. Information about least- restrictive alternatives must be provided to the person before pursuing guardianship. The following are some less restrictive alternatives to guardianship. Power of Attorney for Health Care Assistance with health care decisions can be provided by a properly executed power of attorney for health care. This document specifies an agent who has authority to make medical decisions. This document can also provide a person’s preferences. Power of Attorney for Finances Assistance with financial matters can be provided by a properly executed power of attorney for finances. This document specifies an agent who has authority to make financial decisions, and it specifies what type of financial transactions are authorized. Supported Decision-Making Agreements A supported decision-making agreement allows a person to name someone to formally assist them in making their own choices. These choices can include living arrangements and health care, with the input and advice of a person or team of supporters they choose, know, and trust.

Finances can also be managed through the creation of a trust, where the assets are managed by the trustee for the benefit of the beneficiary under the terms in the trust document. A trust is not mentioned specifically in the new statute, so you would not need to show this option was considered before pursuing guardianship, but it is an excellent way to plan ahead. If you are considering guardianship, you must explain whether less restrictive alternatives are available and sufficient to meet the needs of the adult person. Under this new law, the Court will not accept a transfer of a guardianship from another state unless proof is shown that the least restrictive alternatives were considered. Guardianship has always been a last resort. It is much preferred to put your plan in place while you still have

capacity. If you have any questions about guardianship or planning ahead, give us a call.

Food on Wheels The Nutty Cruiser Rolls Out

Food companies have tried every trick in the book to get your attention, but few can beat the simple charm of a giant snack rolling down the street. It all started early in the 20th century when people dressed up cars with quirky decorations to drum up business. The most famous example came in 1936, when the Oscar Mayer Wienermobile hit the road and turned heads everywhere it went. The tradition is still alive today, and the newest edition is as nutty as they come. Blue Diamond’s Nutty Cruiser is a 20-foot-long almond on wheels, designed to spread the love for almonds across America. It even has attention. Inside, it has room for 10,000 snack packs, making it one of the tastiest vehicles on the highway. The Nutty Cruiser tours state fairs, sporting events, and festivals and draws a crowd wherever it goes. Drivers say it handles surprisingly well, thanks to its smooth, aerodynamic design — though they still get pulled over by curious police officers who just want a closer look. From hot dogs to nuts, food-shaped vehicles have a strange way of sticking around. Maybe it’s because they’re fun, a little bit ridiculous, and impossible to ignore. In a world full of billboards and pop-up ads, there’s still something special about spotting a giant almond cruising down the highway. need to review and likely update your estate plan. Receiving a life- changing diagnosis is certainly no exception. As soon as you learn this news, you and your loved one should immediately review your plans to ensure it reflects your wishes and new circumstances. You may wish to update the decision makers in your documents, so that the person with dementia is not named. Some clients do not like to take out the person with dementia, so you then need to make sure you have good contingent decision- makers in place. You may also want to update the distribution. You will not want to leave assets outright to someone with dementia, so including some

protective trust provisions can be a good idea. The person with dementia should execute documents as soon as possible, if they do not have documents in place. We receive many calls throughout the year that “Mom just didn’t get around to it and now we have no choice but to pursue guardianship.” Ideally, you will already have included long-term care and end- of-life planning in your estate plan, but a diagnosis is a good time to review these options. If you have any questions about estate planning after a dementia diagnosis or need to make updates, please call us today!

Life starts to look different after your loved one receives a dementia diagnosis. You may begin worrying about the future, wondering if your loved one will forget you or the details of your life together. Questions quickly pop into your mind. How can I ensure my spouse is taken care of if I’m no longer around? How can I help Mom? Whenever you experience a significant life change, such as a divorce or the birth of a child, you

The $100K Reason to Get a Pet New Study Says Pets Are Worth Plenty

Creamy Cauliflower Soup Inspired by CookieAndKate.com

Most pet owners already know their furry friends make life better, but according to a new study, the value might be higher than anyone realized. Some researchers say it’s close to $100,000. Researchers in the U.K. aimed to measure how much happiness dogs and cats bring to people’s lives. Using data from more than 700 people, they found that owning a pet can boost life satisfaction as much as getting married or landing a massive raise. In economic terms, it’s the emotional equivalent of earning nearly $93,000 more per year. To determine whether pets actually improve happiness, rather than the opposite — happy people are more likely to have pets — the team factored in things like age, income, personality traits, and family size. They also used a clever workaround: They asked people whether they look after their neighbor’s house while they’re away. That behavior is linked to pet ownership but not directly to happiness, which helped researchers isolate the impact of pet ownership. It’s not just a fun fact, either. Experts say findings like this could affect everything from housing laws to public health programs. If pets fight loneliness and lift people’s moods, it might make sense to rethink rules that prevent pet ownership in some apartments and assisted living facilities. While the researchers focused only on cats and dogs, the message came through clearly. Pets matter, maybe even more than we thought. And if you already live with one and know how they benefit your well-being, the science now backs you up. That wagging tail or soft purr might be worth more than you ever guessed.

Grandparents Make Life Sweeter

Family is the best. This month, we have a special chance to reflect on one of life’s most special relationships on National Grandparents’ Day. Everyone loves an involved grandparent, even us dogs! When Grandpa comes to visit us, he always

brings us dogs yummy treats. We run and greet him at the door just waiting to see what he brought. Grandparents are great. They’re there to pick you up on a bad day, shower you with love when you need it most, and spoil you like nobody else can. My grandma is not with us and I did not get to meet her. She loved dogs very much. Mom is always telling us stories about her. If you’re lucky enough to have a grandparent in your life, be sure to spend time with them. Watch their favorite show or movie with them, take them to their

favorite restaurant, participate in their hobbies, and learn about their history. This is your chance to discover your family’s origins and gain inspiration to carry on their legacy. If you are a grandparent, connect with the youngest generation in your family. This is your opportunity to build memories and pass on a legacy. It doesn’t just happen by chance, but through consistent attention. And don’t forget to include the family dogs! We’d love to come along for the ride and yummy treats!
