INSURANCE COMPANIES STILL WANT MORE? THEY SHOULD PAY THEIR DUES BEFORE DEMANDING REFORM

Last month, new legislation was introduced by an upstate Senator who has spent his career defending Allstate Insurance Company. This bill will fundamentally alter the way the Courts in South Carolina have operated for the last 250 years. There has been a considerable push in the last two years to amend the state’s liquor liability laws to reduce the premiums paid by restaurants and bars in South Carolina. There is certainly some reform necessary in this area, as the laws related to this issue do not make a lot of sense. However, the legislation that has been proposed is backed by the trucking industry and will actually make costs go up for restaurants and bars by requiring that they have more coverage. Senate Bill 244, or as I like to call it, the “Insurance Welfare Act,” isn’t about fairness. It’s about boosting profits for insurance companies already raking in record-setting revenue, and it comes at the direct expense of everyday South Carolinians. Let’s be clear: Insurance companies are not struggling. In fact, they’re thriving . In 2023 alone, the carriers operating in South Carolina reported an additional $700 million in profits compared to the previous year. That’s not a typo — $700 million more. These companies are sitting comfortably, their executives pocketing million-dollar bonuses, while they systematically deny valid claims, delay payments to families in crisis, and force injured individuals into exhausting legal battles. And now, they want to

rewrite the rules to make it even harder for our citizens and small businesses to hold them accountable. The bill contains a number of provisions that will impact the Constitutional rights of the victims of government corruption, patients who fall victim to reckless and grossly negligent medical care, and homeowners whose homes were built with defective construction. What’s especially infuriating is how they dress this up in the language of “reform” and “fairness.” They’ll tell you it’s about lowering insurance rates or reducing frivolous lawsuits. But here’s the truth: We’ve seen this playbook before, and it’s a lie. In 2005 South Carolina enacted sweeping laws regarding medical malpractice. The year after the law took effect, insurance premiums for medical providers went up 18%. In 2020, Louisiana passed the Louisiana Civil Reform Act, promising it would slash car insurance rates by 25%. However, rates went up. Even Louisiana’s Republican Governor Jeff Landry admitted as much, warning his constituents, “Fool me once, shame on you. Fool me twice, shame on me.” South Carolina, don’t let them fool us. Here’s what happens when laws like this pass: Insurance companies face fewer consequences for bad behavior. They can deny your claim with impunity, drag out your case for years, and bet on the fact that you’ll give up before they ever have to pay. This isn’t hypothetical. It’s happening

right now. I’ve seen injured workers on the brink of bankruptcy because their rightful claims were tied up in red tape. I’ve met disaster victims still living in temporary shelters, not because help isn’t available, but because insurance companies refuse to pay out what they owe. I’ve seen elderly nursing home residents neglected because insurers denied coverage for essential care. This bill will only make things worse. The solution isn’t to gut our legal protections. It’s to demand that insurance companies do their job — honor their policies, pay legitimate claims promptly, and stop using delay tactics to pad their profits. If they want to talk about reform, fine. But let’s start with them. It’s time we saw these companies prioritize people over profits. That’s why I’m asking you — no, urging you — to contact your local legislator today. Tell them to vote “NO” on Senate Bill 244. Tell them South Carolina doesn’t need to make it easier for billion-dollar insurance companies to dodge responsibility. We need leaders who stand up for the people who elected them, not for corporations that line their pockets. Your voice matters. Your story matters. Let’s make sure they hear us loud and clear.

THE BIG FIX The Biggest Scandal in MLB History

If you had dedicated your life to a sport, and the team you played for made it to the championship in its premier professional league, how much would it cost for you to throw that opportunity away? This was not a hypothetical question for the 1919 Chicago White Sox but an actual offer. The White Sox were about to play in the World Series against the Cincinnati Reds, but the players were underpaid and disgruntled, which gave gambler Joseph “Sport” Sullivan an opening. Sullivan offered the White Sox players a payout of $100,000 — the equivalent of over $1.8 million today — to throw the series, and many jumped at the opportunity. The White Sox were favored to win the World Series 3:1, and sports media pundits at the time were convinced they would win easily. Then they took Sullivan’s pitch, and sentiments began to change. Rumors swirled about a possible fix. After horrific performances from those involved, the White Sox lost

their first game to the Reds 9–1, the second game 4–2, and after five games, they were down in the series 4–1. But Sullivan’s promised payments failed to meet the amount promised. He delayed the per-defeat payments, and the players were furious at being stiffed. The Sox began to play to their full potential, winning the next two games 5–4 and 4–1. Then, despite playing to win, they lost game eight of the series 10–5. Journalists investigated the rumors that the World Series was fixed, and eventually, the players involved were charged with conspiracy. However, after making their sworn confessions to a grand jury, the transcripts of their testimony mysteriously disappeared. Without crucial evidence against them, the players were acquitted. Despite this, the MLB banned them from the league for life, and the team was given the infamous moniker the “Black Sox.”

Your Guide Through Multi-State and International Claims When Injuries Happen Far From Home, We’ve Got You Covered

When Accidents Happen Overseas International accidents add an extra layer of complexity. Imagine driving through the winding roads of Europe when a collision occurs. What do you do? Start by contacting local authorities and requesting an interpreter if necessary. Obtain a copy of the police report and take meticulous notes and photos of the scene. In Europe, the European Accident Statement (EAS) may come into play. This standardized form streamlines insurance claims, but only sign it if you fully understand its contents. Keep a copy for your records. Whether it’s a slip-and-fall at a resort or an injury during a guided tour, the rules are the same: Document everything, file a report, and consult legal professionals who understand cross-jurisdictional cases. Support Beyond South Carolina Accidents away from home are daunting, but you’re not alone. At Evans Moore Law, we often handle injury cases across state lines. If your case requires litigation outside of South Carolina, we’ll connect you with top-notch attorneys wherever you are and will be by your side along the way. Don’t let legal confusion add to the stress of an accident. We’re here to guide you through every twist and turn, ensuring you focus on what matters most — healing and moving forward. Let us take the burden off your shoulders.

Spring break brings adventure, new destinations, and, unfortunately, a higher chance of unexpected mishaps. If you find yourself navigating the aftermath of an out-of-state or international accident, understanding your rights and acting swiftly can make all the difference. Out-of-State Accidents: Know the Rules of the Road Oftentimes, if you’re involved in an accident while traveling in a different state, the laws of that state apply. This means procedural requirements, such as statutes of limitations, will be dictated by the location of the crash. Additionally, you’ll likely need to file a lawsuit in the state where the at-fault party resides. Fortunately, your car insurance provides coverage across the entire U.S., offering some peace of mind as you navigate the situation. However, out-of-state cases can still involve unique legal nuances, so seeking guidance from an experienced attorney is essential. Steps to Take Immediately No matter where you are, these steps will protect your claim and pave the way for justice: • Call 911 to report the incident • File a police report and request a copy for your records • Contact your insurance company

• Take photographs of the accident scene • Gather any witness’s contact information • Contact an attorney who can provide direction
