Covenants and Restrictions which relate to the maintenanc-e, operation and. repair of the swface wate-r or storrawater management system. Section ~.29 Draift8:ge S~ales ,The developer has construct ed drairiage swales upon each lot for the purpose of managing and containing the flow of excess surface water, if any, f otu1d upon such lot from ti8me to time. Each lot owner, including builders, shall be res.ponsible maintenance, operation and repair of the swales on the lot. Maintenance, operation and repair shall mean the exercise of practices, such as mowing and erosion repair, which allow the swales to provide drainage, water storage, conveyance and other stormwater management capabilities as perrr,itted by tl1e Saint Johns River Water District. Filling, excavation, construction of fences or othet"\Vise obstructing the surface water flow in the S¥lales is prohibited. No alteratior1 of the drainage s\'Vale shall be authorized and any dam.age to any Drainage Swale, whether cause•d by natural or human- induced phenomena, shall be repaired and the Draina.ge Swale returned to its former condition as soon as possible by the owner(s) of the Lot(s) upon which the Drainage Swale is located. Section 2.30 PrgperlY Renta\ Short term rental of Single-family residential imits is prohibited. Rentals must be for Six (6) months or longer. Section .3.1. ~eJllb~rship. The owner of each Lot and the owne~r of each Dwelling Unit (all Subdivision Phases and all Units) shall automatically and mandatorily become a member ofthe Owners Association and the Neighborhood Association (if applicable) upon his or her acquisition of any ownership interest in the title to any Lot or Dwelling Unit. Th.e men1berships of such o\Vllerships of such owners shall terminate automatically at the time that such persons div·est himself or is divested of such ownership interest or title, regardless of tl1e means by which such ownership may have been divested. Secti9n 3.2..Members!Jip Limlts. No person or corporation or other business entity holding any lien, mortgage or other encumbrance upon any Lot or Dwelling Unit shall be entitled by virtue of such lien, mortgage or other encumbrance, to membership in the Associations, or be charged with any of the duties of such membership; provided, however, that nothing contained herein shal 1 be construed as prohibiting membership in the Associations of a person, corporation, or other business entity which acquires title to a Lot or Thvelling Unit either by foreclosure or by 12
