ENFORCEMENT PROCEDURE

16.01 Pursuant to Section 4.13 of the Declaration, the Association shtlll have the right to levy f mes against an 0\'\11er or its guests, relatives~ or lessees, i11 the manner ·providE:d herein, and such fines shat 1 be col]ectible as provided under Chapter 720 FJorida Statutes.., 16.02 Each Board of Directors (the Appointing Board) shall have the power to create an Enforcement Committee: to be comprised of three (3) n1en1bers who are n<>t officers, directors, or employees of the Association or the spouse, parent, child, brother, or sister o:f an officer, director, or emplo~'ee of the Association. The Enforcement Com1nittee shall serve a term consistent Mth the term of its Appointing Board~ Members of the Enforcement Committee may be replaced with or without cause b)/ majority vote ofthe Appointing Board. 16 .. 03 At least 14 days prio1 to a hearing of the E,nfo:rcen.1ent Committee being called,: alleged Non-complying Members shall be notified by certified maiJ!t return receipt requested or by hand delivery, of the alleged Non-complying condition and be given a reasonable opportunity thereafter to rectify the alleged Non- comp1; 1 ing condition.

16.04 Conduct of Enforcement Hearing;

(1) Alleged Non-complying Members shall be notified by certified mail, retum receipt requested, or by hand delivery, of s. hearing at least fourteen (14) days in advance of said hearing~ No alleged Non-complying Mernber sl1all be given notice of hearing before the l~nforcement Committee unless said Alleged Non-Complying Metnber has first beerl given reasonable O]?POrtunity to rectify the ,illeged Non- complying condition. (2) 1be Chairperson of the Enforcement Comn1ittee may call hearings of the Enforcement Committee; hearings may also be c-alled by· written notice signed by any member of the Enforcement Committee A (3) The Chairperson shall present each case before the entire Enforcement Committee, and the Alleged Non-complying Member: shall be given reasonable opportunity to be heard after the Chairperson's presentation~ Fonna1 rules of ev'idence shall not apply, but fundana.ental due process shall be obsen,ed and shall govern said proceedings. (4) At the conclusion of the hearing, the Enforcement Committeie shall issue an order affording the proper relief, if any, consistent witb the powers granted herein, 1ne orders shall be by motion approved by at least two (2) members of the Enforcement Committee in order for the action to be <Jfficial~
