Long Service Leave is one of the most complex of leave types governed by: Various Employment arrangements. To name a few: National Employment Standards A Pre-Modern Award dated before 1 January 2010. Collective Agreement after 26 March 2006 Enterprise Agreements
In the 1860s, the vast majority of those in government administration in, the then, Australian colonies were British subjects. Public servants would sail to Australia to take up residence, a journey that would take at least a month. To support workers in Victoria and South Australia, they were granted a furlough after ten years to sail home to England. The furlough was three months long to allow for two months of travel there and back and a month of recreation in England. After 1950, this entitlement was extended to other Australian workers in response to social pressures stemming from growing numbers of immigrants coming to Australia. In contemporary Australia, LSL is a period of leave granted to employees who have maintained a continuous and significant length of service with a single employing company. To ensure compliance with long service leave laws, it’s essential to evaluate the specific requirements outlined in each of the various legislations covering LSL specific to each jurisdiction, that being the state or territory, your employees work in. These laws set out elements such as how long an employee must be working to get long service leave, the length of leave each employee is entitled to, and how payment of the leave is calculated.

Each component of Long Service Leave: length of service, length of entitlement and how payment is to be calculated – and in some circumstances, multiple calculations covering different periods. Should there be no award or agreement regarding long service leave in place for your company, the entitlement to long service leave comes from State and Territory laws. Maintaining compliance requires vigilance of the constant changes to each of the various legislations.
