All Charter LEA members who join the Charter SELPA will be required to have their governing school boards approve the Local Plan for special education. Section E – Agreement for Participation The Charter SELPA as authorized by the California State Board of Education assists California charter schools that have successfully completed the Charter SELPA membership process and have signed an Agreement for Participation. Charter schools accepted into the Charter SELPA are deemed Local Education Agencies (LEAs) pursuant to Education Code § 47641 and are obligated to provide special education and related services to applying or enrolled students actually, or potentially entitled to services under applicable state and federal laws and regulations. The Agreement for Participation details the Charter LEA member, the Office of the San Bernardino County Superintendent of Schools, and the Charter SELPA’s mutual agreement for the provision of services under the Local Plan. The Charter SELPA endeavors that all children with disabilities attending Charter LEA members shall receive appropriate special education services, and that such special education programs and services shall be coordinated and operated in the Charter SELPA in accordance with the approved
policies and procedures defined in the Agreement for Participation. Refer to Appendix C for Charter SELPA Agreement for Participation.
