SETTLEMENT AGREEMENT AND LEGAL ADVISORY APPENDIX B: DIASTAT ADMINISTRATION IN SCHOOLS: SUMMARY OF RELEVANT FEDERAL LAWS AND SELECTED CASES APPENDIX C: SDCOE DIAZEPAM GUIDELINES (ADMINISTRATION OF DIASTAT®) Introduction Children within the Desert/Mountain Charter Special Education Local Plan Area (SELPA) who require health care services during the course of their school day, which are necessary for them to regularly attend and benefit from the instructional program, shall be provided these services by the Charter Local Educational Agency (LEA). Health and nursing services are considered a “related service” if they are necessary in order for the child to benefit from their specialized academic instruction. (See Chapter 22, Supports and Services, for further details regarding related services.) The need for these services is discussed and reviewed during the Individualized Education Program (IEP) meeting. At that time, a health plan for the child is developed and becomes a permanent part of the child’s IEP. Section A – Prohibition of Mandatory Medicine It shall be the policy of the Charter LEA to prohibit school personnel from requiring a child to obtain a prescription for a substance covered by the Controlled Substances Act as a condition of attending school, receiving an evaluation for special education, or receiving special education services.
