AF&PA Opposes Passage Of Drafted EPR Bills For New York

Activity related to the New York state EPR for paper and packaging bills has increased with just a few weeks re- maining in session. In response, AF&PA is activating some of its advocacy resources to maximize impact and encour- age members with resources in New York to do the same. AF&PA opposes the passage of any of the NY EPR bills as currently drafted due to their impact on the paper in- dustry. Additionally, the state is funding a statewide needs assessment and we believe it would be shortsighted to pass an EPR bill before that process is complete. AF&PA has activated a grassroots alert. AF&PA is also developing social media to complement our out- reach efforts. There are four different bills related to EPR under con- sideration in New York: • S.4246/A.5322: Enacts the “Packaging Reduction and Recycling Infrastructure Act” (companion to AB 5322) Includes paper and packaging- with packaging defi- nition so broad it could be construed to include even wood pallets. Sets requirements for recovery rate, re- cycling rate, source reduction, and material-specific postconsumer recycled content (PCR) rate. • S.1064: Establishes an Extended Producer Responsibil- ity Program For Packaging:Printing papers not includ- ed. Onerous labeling requirements and toxic chemicals can be basis for packaging bans or deeming not-recy- clable. Sets requirements for non-reusable packaging reduction rate and PCR rate. • S.6540: Establishes an Extended Producer Responsi- bility Program For Designated Products: State agency to decide what products have individual EPR programs on an annual basis and craft plans based on products and key factors listed in bill.
