Special Provisions

• This real estate is selling subject to public road easements and all other easements of record. • All fences and fence lines shall be governed by the Lee County and State of Iowa fence line rules and regulations. • It will be the responsibility of the new buyer(s) to show proof of purchase to the Lee County FSA Office so that he/she will receive any future government payments. • If any access driveways are needed, said driveway installation & costs will be at the buyer(s) expense. • Subject to the Iowa Septic System “Time of Transfer” Law, Tract 5 is exempt from any septic system testing or upgrades. Any septic system testing or upgrades will be at the buyer(s) expense. • All tracts sell subject to a farm lease for the 2018 crop year, with the said lease ending March 1, 2019. • The tenant (Martin Durr) will be served lease termination prior to September 1, 2018. • All personal property including farm equipment, corral gates, posts, wire, etc, on all tracts are being reserved for the tenant. • If in the future a site clean up is required, it will be at the expense of the buyer(s).

Method & Terms

All 16 tracts are currently being surveyed. Tracts 1 - 4 and 6 - 16 will be sold on a price per acres basis, based on the survey. Tract 5 will be sold for a LUMP SUM total dollar amount. Tracts 1 - 4 will be sold first and will be offered through the marketing method of “Buyer’s Choice”, whereas the high bidder can take any or all tracts for their high bid. “Buyer’s Choice” will continue until all four tracts have been sold. Tract 5 will be sold next for a LUMP SUM total dollar amount. Tracts 6 - 16 will then be offered through the marketing method of “Buyer’s Choice”, whereas the high bidder can take any or all tracts for their high bid. “Buyer’s Choice” will continue until all eleven tracts have been sold. The tracts will NOT be offered in their entirety or in any combinations at the conclusion of the auction. Ten (10%) percent of the bid price to be due on the day of sale, with the balance due on or before Friday, September 28, 2018, upon delivery of a merchantable abstract and deed. Immediately following the auction, the successful bidder shall enter into a written agreement with the sellers. Bidding is NOT contingent upon financing. The real estate taxes will be prorated to the date of closing. Possession will be given at the time of closing on Tracts 1 - 4 and 6 - 16, subject only to a farm lease for the 2018 crop year. Full possession of the home on Tract 5 will be granted at the time of closing; the outbuildings will be subject to the current tenants 2018 farm lease. All tracts sell free & clear for the 2019 crop year. There are no hunting leases associated with any of the tracts. All announcements sale day shall take precedence over any prior advertising, either written or oral.
