cases as well as imposing disciplinary actions. 3) The LSBME should develop guidance, such as an 1 enforcement guide, that provides a consistent process involving a graduated and equitable system of 2 sanctions that specifies criteria including the type, number, and severity of violations that should trigger 3 each level of sanctions, and promulgate this guidance in rules under the Administrative Procedures Act. 4 5 Mr. Williams stated that it’s been approximately fifteen (15) months since the report was issued and 6 there still hasn’t been anything published and that’s what members were calling him about and voicing 7 their concern as the LSMS fought very hard in 2017 for due process rights for physicians. Mr. Williams 8 also stated that he had spoken to the LSBME Executive Director and was assured the rules were in the 9 rule-making process but were not available yet to share. After some additional discussion, the 10 following motion was made:

DIRECT STAFF TO PROVIDE THE LSMS BOARD OF GOVERNORS WITH A COPY OF THE RULES WHEN THEY ARE AVAILABLE AND TO ADDITIONALLY RESEARCH OTHER STATE MEDICAL BOARDS, THE FEDERALTION OF STATE MEDICAL BOARDS AND THE AMERICAN MEDICAL ASSOCIATION FOR SIMILAR RULES IN ORDER TO COMPARE AND CONTRAST THE FINAL LOUISIANA

RULES FROM THE LSBME.

Proposed 2021 Meeting Calendar

24 Dr. Williams reviewed the proposed dates for board meetings in 2021, which included: March 3 rd , June 25 9, September 1 st and December 8 th . Without any objection, the follow motion was made:

THE LSMS BOARD OF GOVERNORS MEETING DATES FOR 2021 WILL BE MARCH 3 RD , JUNE 9, SEPTEMBER 1, AND DECEMBER 8 TH .

30 31 32 LSMS Member – Virtual Engagement Portal (M-VEP) 33 Dr. Williams reminded everyone that a virtual option to potentially replace our current in-person House 34 of Delegates had been discussed during the board’s August 11, 2020 meeting but no action was taken as 35 there was a concern that what was proposed might potentially be in violation of our bylaws. As a result, 36 the Speakers and staff have gone back to the drawing board and refined the proposed process to create a 37 new hybrid system with virtual and in-person components that will complement our current House of 38 Delegates without violating any of our bylaws. Dr. Trawick stated that he believes the new proposed 39 process will not only make our House more effective but also more efficient thus allowing us to convert 40 part of our annual meeting into more breakout sessions and general sessions with the business of the 41 House taking less time. Mr. Williams then summarized the proposed process, which allows any member 42 of the LSMS the ability, through a virtual engagement portal located on the LSMS Website, to submit a 43 resolution (issue, suggestion, idea, etc.) at any time throughout the year. The resolution is then 44 forwarded electronically to the LSMS Legal Affairs department where an impact analysis is completed 45 within two weeks. During this time, the resolution is reviewed against exiting LSMS policies and 46 Louisiana laws to ensure its content fits within the mission of the society and legal framework of the 47 state. The results of the legal review are then forwarded to the Speakers with a legal recommendation to 48 either accept or reject along with the rational for either recommendation. The Speakers then review the 49 resolution and the legal analysis and either accept the resolution as business of the LSMS or reject. If 50
