From the Law Blog: Medical Marijuana Legal in Florida —What Does That Mean?
If you’ve been keeping up with the newsletter or our law blog, then you know we’ve been talking about potential legalization in Florida. We predicted it would happen several months ago. In the buildup to the legalization of medical marijuana, a judge in Tallahassee ruled the ban on smoking prescribed marijuana unconstitutional last May.
Prior to the change in legislation, the odor of marijuana in a vehicle gave rise to probable cause for a search. Since the use of medical marijuana was legalized, we have argued that the odor of raw marijuana is not probable cause until it is determined that the defendant didn’t have a prescription.
The courts will now have to look at whether the odor of burnt marijuana needs a similar inquiry before a search is legal. We will see what happens next.
The ruling created a conflict in the law. In March, Florida Governor Ron DeSantis signed legislation to repeal the ban on smoking medical marijuana.

In 2016, a majority of voters supported a constitutional amendment allowing the use of medical marijuana. Those in favor far outweighed those who were not, at 70% in favor. But voters were ignored when former Governor Rick Scott signed a law to ban all marijuana smoking for any purpose. So what happened this year? Gov. DeSantis filed a motion to dismiss the State’s appeal of the Tallahassee order. Along with the order, the governor signed legislation that made smoking an acceptable form of a “marijuana delivery device.” What changes? Patients can now receive 2.5 ounces of whole-flower cannabis every 35 days. The changes are currently rolling out and more patients now have access to marijuana.

Directions
1. Bring a medium stockpot of salted water to a boil. 2. Boil potatoes until fork tender, about 20–30 minutes. 3. In the meantime, finely chop onion and gherkins. 4. When potatoes are done cooking, strain and place in large salad bowl with onion and gherkins. 5. For dressing, whisk together mustard, olive oil, garlic powder, salt, and pepper. It’s best to add oil gradually at the end. 6. Dress salad and let sit for 15 minutes to absorb flavor before serving.
