SECRETARY'S REPORT On Reflection of the Recall…. Now that the votes are in and reflecting on the recent Recall Election, I wanted to share some information, generally, on recalls. First, understand that our governing documents must comply with State law that provides that, with the
Happy New Year! Our Resort looks stunning this year, thanks to the effort of many of our owners, our excellent staff and contractors. The Facility Planning Committee has been very busy the last couple of months tackling some of the updates and concerns of our fabulous facilities. Our committee has formed a successful Kitchen Focus Group of 13 owners and users who met in November to share their input, ideas and invaluable knowledge on what are the needs of various groups that use the ES kitchen. A LICE H EUPLE is heading up this focus group and will be developing a plan for any updates or changes to be made in the upcoming and subsequent years. Funds for the kitchen project are limited at this time, so a phased plan will be developed with the most critical items being addressed first. At our last committee meeting Board Director, S KIP P ISOR , shared information regarding the residential development that is in the planning process taking place to the west of our Resort. There has been discussion of relocating the dog facilities and creating a dog run area near the current facilities in exchange for emergency access to the planned development. Skip also informed the committee that as part of this residential development, which is still in the planning stages, that a parcel of land may become available to purchase sometime in the future. Our committee will consider the potential uses of this parcel and how it could benefit our Resort for such things as dog run, sports activities, storage and entertainment to name a few. Because zoning issues and lot line adjustments are necessary, this process may take time. And it will take money. The Facilities Planning Committee would like to pursue some of these possibilities. Keep in mind that these plans can be actualized if we plan ahead with fund raising and/or commitment of the owners for some of our special projects. C LINT A THERTON has also shared with the committee how other Resorts have used entities and fund raising to accomplish their goals. We will keep you informed as these plans develop. Finally, we would like to find resident art connoisseurs or owners with art dealer knowledge to assist in selling a few art items belonging to our Resort. submission of a valid petition signed by 5% of the eligible voting membership, an election to recall a director must be held . What is a valid petition? One that is signed by only 5% of the voting membership. In our case, that equates to only 65 signatures. There are unintended consequences of recalls. Mistrust, organizational dysfunction, loss of the pleasure and enjoyment of activities with friends and neighbors. And, there is a fiscal cost. The recent recall election cost $5,000 and with incidental direct and indirect costs that could be added, that figure could be thousands more. If the recall had been successful, another election would have been required. This would have equated to more than $1.00 per month per owner. Recall is the only recourse available to owners to remove elected directors who seriously breach any duty or recognized standard of conduct. It is a right, recognized in law, and should be respected. But it should also be used with discretion !
