State Emission Bills Several outdoor power equipment (“lawn and garden”) related state bills have been introduced in 2025. States where “lawn and garden” bills have been introduced include AR, CT, HI, IA, IN, MA, MD, NY, OR, RI, TX, UT, and VA. Similar to recent years, new bills from these states are focused on emissions and often supported by CARB (misleading / unsupported) data or “facts”. Generally, bills are (1) gas- powered “lawn equipment” and leaf blower sales and use bans (for general population and/or state use), (2) bills prohibiting municipalities from banning equipment based on power source (“ban a ban” bills), or (3) tax / incentive programs. OPEI comments in opposition of ban bills if they are scheduled for hearings. The OPEI EFC & LRC recently unanimously approved an updated comment letter for opposing bans. (ATTACHMENT)

o CO EO D-2025-003, EO 4/22/2025 – “ban” – Requires agencies to purchase electric lawn and garden equipment to meet the Air Quality Control Commissions’ rule prohibiting gas-powered equipment. o AR HB 1075, filed 1/3/2025, ENACTED 2/25/2025 – “ban a ban” – Prohibits local governments from regulating sale of lawn care devices or imposing a tax or fee on use of lawn care devises. o IA HF 860, filed 3/17, PASSED HOUSE 3/19, PASSED SENATE 4/8, ENACTED 4/18 – “ban a ban” – Prohibits a government entity from adopting or continuing an effort that prohibits a person from possessing, acquiring or operating gas- powered equipment. o IN HB 1389, filed 1/13/2024, PASSED HOUSE 2/17, PASSED SENATE 4/25/2025 – “ban a ban” – Prohibits local government from adopting or enforcing (policy) that prohibits or restricts the use or sale of vehicles and outdoor power equipment based on fuel source. o NY S 1574 / A 2657, filed 1/10/2027, PASSED SENATE 3/17/2025– “incentive” – Establishes electric landscaping equipment rebate program. o UT SB 124, filed , PASSED HOUSE 3/4/2024 – ban – Requires that procured landscape maintenance be electric-powered. As introduced, would have created a timeline of increasing prohibitions on the use of gas-powered lawn equipment for state government facilities, with full ban by 7/1/2027. • Have not moved (beyond chamber of introduction)
