TERMS AND CONDITIONS

for the 2026 NW Children

’ s Foundation Gala + Auction

1. Placing a bid – in person or via proxy bidding

– constitutes acceptance of the

terms of sale as outlined herein. If your bid is the top bid, it is a legal contract to purchase the auction item. A bid by any person shall be conclusive proof that the person has read these conditions of sale and has agreed to be bound by them. Bidder expressly agrees not to stop payment, dispute or contest this transaction. 2. All purchases are final and there will be no extensions, exchanges, or refunds on items. All goods and services must be claimed and used within twelve months of the auction close date (May 2, 2027), unless otherwise noted in the auction item description. 3. Please review the item descriptions carefully. Some items may have restrictions, expiration dates, or specific dates of availability that cannot be changed or altered. Every attempt has been made to describe accurately each item. NW Children ’ s Foundation (NWCF) neither warrants nor represents, and in no event shall be responsible for the correctness of descriptions, genuineness, authorship, provenance, or condition of the items. Estimated values are listed as stated by the donors. Items have not been appraised unless otherwise noted. 4. Pick up of purchased items: All items should be picked up by the winning bidder as they leave Fremont Studios on May 2. Any item not taken on May 2 must be picked up from the NW Children ’ s Foundation offices no later than Friday, May 8. 5. All vacations and travel items or services are subject to availability and are not the responsibility of NWCF. Reservations for trips and vacation accommodations must be mutually agreed upon with the donor. All contact information will be provided to you when you receive your items. Air tickets must be booked and all air travel completed by the stated expiration date. No refunds will be issued. 6. Live Auction: The Live Auction will begin during dinner and will continue without intermission until all items have been auctioned. To enter a bid, signal either the auctioneer or one of the spotters with your bid card. The auctioneer will determine the successful bidder. Winning Live Auction bids will be secured as legal contracts to buy once acknowledged by the auctioneer and with the purchaser ’ s signature on the bid sheet, which will be brought to your table. In the event that there is any dispute between bidders, the auctioneer shall have the sole and final discretion to determine
