LEGAL CHALLENGES Western Growers was actively engaged in an unprecedented number of legal challenges on behalf of our members and the broader agriculture industry: Western Growers v. Cal/OSHA Standards Board: Western Growers led the agriculture and general industry’s litigation efforts challenging Cal/OSHA’s COVID-19 Emergency Temporary Standard before the trial court and court of appeals. Western Growers v. City of Coachella: Western Growers oversaw the agricultural coalition’s litigation efforts challenging the City of Coachella’s “Hero Pay” ordinance. Cedar Point Nursery v. Hassid: Western Growers led efforts to file an amicus brief in the U.S. Supreme Court on behalf of a California agricultural coalition. The issue in the Cedar Point Nursery case was whether the California Agricultural Labor Relations Board’s so-called “Access Rule” violates the Fifth Amendment of the U.S. Constitution. Almond Alliance et al. v. Fish and Game Commission et al.: Western Growers participated in the case, which defended on appeal the Superior Court’s ruling upholding a challenge to a decision by the California Fish and Game Commission to designate four subspecies of bumble bees as candidates for protection under the California Endangered Species Act (CESA).
