Stop IRSCollectionAgencyCallsWith a Simple Letter Recently, a client came to me because he had received a notice from the IRS stating that they were sending him to a collection agency for his unpaid debt. The debt itself was old (most debts that are sent to a collection agency are), and he had started to receive phone calls from the agency about payment. This was the second time in 18 years that my client had been sent to collections, but this time, the phone calls and notices he was receiving were getting to be more than inconvenient.

My client began getting daily calls and, after a while, he was sick of the threats and sought out legal help. As a side note, if you have been sent to a collection agency and have started to get calls, you should be aware that the collector may say things like, “If you don’t pay in full today, we will file a lawsuit against you,” or “If you don’t pay in full today, we will alert the police right away.” However, these statements are false , and collection agencies cannot do either of those things. So, don’t fall for it. Thankfully, there is a way to get a collection agency to stop harassing you. Congress still subjects IRS collection agencies to the Fair Debt Collection Practices Act, which is a law that outlines what these agencies can and can’t do to get you to pay. For instance, if a collection agency is harassing you with daily phone calls, all you have to do is send a written statement to the agency that they need to stop contacting

you, and they have to abide! And that’s exactly what I did for my client. I sent a notice right away, so the agency had to wrap up their case and send it back to the IRS. The Fair Debt Collection Practice Act gives you an out, and if you’ve been contacted, it’s an out you may want to take.
