METHOD & TERMS All 5 tracts will be surveyed. Tracts 1 – 4 will sell by the acre, based on the surveyed acres; Tract 5 will sell for a lump sum, total dollar amount. Tracts 1 – 4 will be offered through the marketing method of “Buyers Choice”, whereas the high bidder can purchase (in any order) any or all 4 tracts for their high bid. “Buyers Choice” auctioning will continue until all 4 tracts have been elected. We will then sell Tract 5. The tracts will NOT be offered together or in any combinations at the conclusion of the auction. Immediately following the auction, the successful buyer(s) will be required to enter into a written Real Estate Sales Contract with the seller and pay ten percent (10%) of the bid price as a non-refundable down payment. The balance of the bid price will be due at the time of closing, on or before December 29, 2022. The seller will provide title insurance in the full amount of the purchase price and pay the 2022 real estate taxes, due and payable in 2023. Buyer to pay the 2023 and all subsequent taxes. Possession on Tracts 1 – 4 will be given at the time of closing subject to any remaining 2022 unharvested crop (These 4 tracts sell free and clear of tenancy for 2023 and beyond). Possession on Tract 5 will be given at closing, however, use of the buildings and grain bins are being reserved until April 1, 2023. There are no agreements in place, and no representations are made, that any pivot irrigation will continue to swing over or provide coverage to any adjoining property or that any pivot irrigation will be permitted to swing over any adjoining property. Any such agreements will be up to the buyers/owners to work out and agree upon after the closing. Bidding is NOT subject to any contingencies, including but not limited to financing, appraisal, or inspection. All announcements sale day shall take precedence over any prior advertising either written or oral.
