of employment, any change in those terms must be negotiated and agreed between the parties concerned. The Wages Act has since been subsumed as part of the Employment Rights Act 1999. COPYRIGHT © 2021 THE CHARTERED INSTITUTE OF PAYROLL PROFESSIONALS PAYE FORMS AND RETURNS P11 Deductions working sheet Strictly speaking the way that payroll software records pay and deductions is the computerised version of a paper P11. The form P11 records the individual pay period by pay period details of each employees PAYE Income Tax, National Insurance Contributions and Statutory Payments. The form, which now includes Student Loan Deductions and other statutory information, or copy should be retained for at least three years after the end of the year to which it relates. P11D/P9D - Annual statement of expense and benefit payments A form P11D (or equivalent) is to be used when reporting expenses and benefits provided to company directors or to employees earning at a rate of £8,500 or more per year. A copy must be provided to each current employee or company director giving details of their individual expenses and benefits. P11Ds are due to HMRC and employees by 6th July annually relating to the previous tax year. The P9D form was used to report a more limited range of employer- provided expense payments or benefits made to an employee earning at a rate of less than £8,500 per year. The last P9D forms applied to the tax year 2015/16 as the threshold for P9D, £8,500 was abolished from 6th April 2016, thereby also abolishing the P9D form. For guidance see https://www.gov.uk/government/publications/paye-end-of-year-expenses-and-benefits- p11d-guide. P35 - employer annual PAYE return The P35 was the Employer Annual PAYE Return of the total PAYE Income Tax deductions, National Insurance Contributions and recovered statutory payments for all employees included on the accompanying P14s. The P35 no longer exists under Real Time Information as FPS submissions are sent each time an employee is paid. A final FPS or Employer Payment Summary (EPS) closes the scheme down for the year by acting as an employer declaration in the same way that the P35 did. No printing, copying or reproduction permitted. P38A - employer supplementary return Form P38A, abolished from 6th April 2013, was used to report payments made during a tax year to employees for whom no P14 or P38(S) had been completed. The P38A no longer exists under Real Time Information; all employees must have a payroll record even if they are paid under the
