No qualifying service required) From 3rd April 2011 Mothers can transfer between 2 and 26 weeks of maternity leave to their partner, formed of a maximum of 19 weeks of SMP and 7 weeks unpaid leave as additional Statutory Paternity Leave and pay Additional Statutory Paternity Leave and pay abolished but mothers can curtail their SML early and transfer the balance of their entitlement to a new shared parental leave arrangement. From 1st February 2016 No printing, copying or reproduction permitted. New rules introduced to all part weeks of service achieved at any time up to and including the QW to be rounded up to a complete week. This means the employee can qualify if her service is in excess of 25 weeks at any time during the QW. SMP Entitlement and qualification from April 2007 • A maximum of 39 weeks SMP, paid 6 weeks @ 90% of Average Weekly Earnings (AWE) and 33 weeks at 90% of earnings (or the current flat rate for SMP), whichever is the lower. • 26 weeks’ Ordinary Maternity Leave and 26 weeks’ Additional Maternity Leave (AML), to run directly from the end of the Ordinary Maternity Leave period, and to be available to all women. • 26 weeks’ service qualification period at the 15th week before the EWC for SMP. • 4 weeks’ notice to start SMP and 4 weeks’ sickness trigger for Pregnancy Related Illnesses which automatically starts the maternity pay period.
