It was abolished from 1st January 2011. PARENTAL BEREAVEMENT - STATUTORY PARENTAL BEREAVEMENT LEAVE (SPBL) AND PAY (SPBP) Introduced on 6th April 2020 to provide parents who lose a child or suffer a stillbirth with a day- one employment right to take two weeks off work. Eligible parents will also be entitled to two weeks’ statutory pay. In April 2020, the Government confirmed that this right is only available to parents in Great Britain. This means that parents in Northern Ireland are not eligible unless they are employed by an employer who is based in Great Britain and whose employment rights are governed by the Employment Rights Act 1996. Definition A child is defined as a child under the age of 18. This captures a broad range of “parents”, including adoptive parents, parents of a child born to a surrogate, parents who are fostering to adopt as well as individuals who have been caring for the child in their own home, continuously for a period of four weeks ending with the date of death, with responsibility for the child’s care during that period. Qualification In order to qualify for statutory parental bereavement leave the employee has to: • have a parental relationship to the deceased child within the broad definition above • supply evidence to the employer in the form of a death certificate where it is practicable to do so • have suffered a stillbirth from the 24th week of pregnancy • be employed by the employer. No printing, copying or r production permitted. SPBP may also be available to foster carers.
