• receive Disability Living Allowance, or Attendance Allowance, or Constant Attendance Allowance with either War Disablement Pension or Industrial Injuries Disablement Benefit, or a Monthly Supplement with War Disablement Pension; or • have an invalid three wheeler vehicle from the DWP; or • have been receiving, within the last 56, days short term Incapacity Benefit at the higher rate, long-term Incapacity Benefit, or Severe Disablement Allowance; or • have been receiving, within the last 56 days, a disability or higher pensioner premium with Income Support, Housing Benefit or Council Tax Benefit. Entitlement was dependant on the claimant’s income, capital and family type. The first £3000 of capital was ignored. Between £3000 and £16000, benefit was reduced by £1 per week for each £250 or part over £3000. Capital over £16,000 disqualified entitlement. In addition, certain other welfare benefits were available where savings were no more than £6,000. COPYRIGHT © 2021 THE CHARTERED INSTITUTE OF PAYROLL PROFESSIONALS EMPLOYMENT AND SUPPORT ALLOWANCE (ESA) Introduced on 27th October 2008 for those incapable of work. ESA replaced Incapacity Benefit and Income Support by 2013. The scheme provides access to specially trained personal advisors, employment training and management support. To qualify for the allowance the claimant must be: • over age 16 and under State Pension Age, and • unemployed, or • self employed, or • working for an employer but unable to get Statutory Sick Pay, or • having received Statutory Sick Pay that has now stopped. ESA is applied in two phases, an assessment and a main phase. It will not be paid for the first three days of the claim (waiting days) and will continue under the assessment phase whilst a decision regarding work capability is assessed (a Work Capability Assessment). The main phase commences from week 14 where illness or disability limits ability to work. Assessment Phase - payable for the first thirteen weeks of the claim period for those eligible, having sick notes and either having paid sufficient National Insurance Contributions or passing a means test similar to that previously used for claimants of Incapacity Benefit. The Work Capability Assessment - comprises a physical and mental health test that is both more demanding and replaces the former Incapacity Benefit. Personal Capability Assessment. Exemptions from the tests may be permitted for terminally ill claimants, some pregnant women and those receiving chemotherapy. No printing, copying or reproduction permitted. Claimant allowances are categorised in three groupings: Work-Related Activity Phase - payable after thirteen weeks (as an additional allowance), subject to the claimant progressing through the assessment stage. To qualify claimants will have to attend work-focused interviews and submit an action plan
