MATERNITY LEAVE AND PAY Ordinary Maternity Leave (OML)

A pregnant employee is entitled to 26 weeks’ ordinary leave, regardless of service, which can start no earlier than 11 weeks before the baby is born. Significant changes were made to leave and statutory pay rules from April 2007. The Notification Week for leave is 15 weeks before the Expected Week of Childbirth (EWC) - 28 days for Statutory Maternity Pay (SMP). A woman is excluded from SSP during the maternity pay period which is deemed a 39-week disqualification period from the first day of entitlement to SMP or Maternity Allowance (MA). If not entitled to SMP or MA the exclusion is only for 18 weeks starting from the earlier of - the first day of absence within 4 weeks of the EWC or the day after the baby is born. Additional Maternity Leave (AML) All women are entitled to take extended leave commencing at the end of Ordinary Maternity Leave period and continuing for a further 26 weeks (for those with an EWC prior to 1st April 2007 the woman had to have 26 weeks’ service at the Notification Week).
