the following groups is deemed at “higher risk” for severe illness from COVID-19. Under the new EEOC guidance, these employees are entitled to request reasonable ac- commodations related to their medical condition: • Individuals 65 years and older; • Individuals who live in a nursing home or long-term care facility; and • Individuals of all ages with underlying medical condi- tions, particularly if not well-controlled, including chron- ic lung disease or moderate to severe asthma, serious heart conditions, immunocompromised, severe obesi- ty (body mass index [BMI] of 40 or higher), diabetes, chronic kidney disease undergoing dialysis; and liver disease. Q: What does an employee need to do in order to re- quest a reasonable accommodation? A: The employee, or a third party, such as his/her doctor may request an accommodation, in conversation or in writ- ing, for an employee’s underlying condition (any of those listed above). Such a request does not need to use the term “reasonable accommodation” or reference the ADA. However, if the employee does not request a reasonable accommodation, the ADA does not mandate that the em- ployer take action. As in any non-COVID-19 related scenarios, employers receiving such requests should engage these employees
