or brokers, developers, lenders and even attor- neys, you likely know a

estate and the fact that title insurance is only one piece of a very big puzzle, a quick refresher of key cautions can never hurt. Title insurance is too important. covenants and survey dis- crepancies can also wreak havoc on the title insurance process – each in their own way. Easement issues, in- cluding utility, access and conservation, account for about 25% of all title claims in commercial real estate and can significantly affect the value of a property. Recorded limitations, such as restrictive covenants, can prevent certain types of businesses from occupying a property and therefore make a property unsuitable for a buyer’s intended purpose.

Similarly, surveys can cause headaches specifically when the legal description of a property doesn’t match the actual physical boundaries. Three basics to know about title insurance agencies: Now that we’ve covered some of the basics regarding title insurance itself, let’s turn to what you may not know. What when the un- expected happens? What if a seemingly “normal” transac- tion goes off course? Three important facts to know: 1) Title insurance (like much in real estate) remains a “people” business; 2) not all title insurance agencies are the same; and 3) having the right title insurance partner is important. Yet what does that really mean? All title insurance agencies will tell you they are avail- able day and night, provide fully-secure transactions us- ing the latest technology and promise on-going communi- cation from start to finish. But those are only words. In the end it all comes down to the people – the names of you know, the faces you see, the voices you turn to – when needed.
