DON’T REMAIN STAGNANT!
THE KONECKY JOURNAL JUNE/JULY 2023
Embrace Change and What It Can Offer You
As you may have noticed, we have new faces, voices, and practices and procedures in the office. Over the past few months, I have made some changes within the office to enhance your experience with us and ensure you receive the best service possible. My team and I are looking forward to the future and finding other ways to progress and strengthen our skills and relationships with you. While I understand that change can be nerve-wracking, it’s necessary! Change is a natural part of life — especially in our fast-paced world. We constantly see adjustments, modifications, and evolutions to the things around us. Just look at technology! The Motorola phone was created in 1973, which changed how we communicate with others. Then, smartphones hit the scene, along with tablets. Now, we have dozens of different innovative technologies we’ve grown accustomed to. While everything around us constantly changes, you and I also change! However, some may resist or reject change because it can be scary to think about. But change can be a great thing! We can reap several benefits from it, too. And today, I wanted to share some of those with you. You can learn something new. Change is all about putting yourself in new environments and situations. It allows you to develop new skills, gain a new perspective, or improve your skills. If you were to try a new hobby, accept a job offer, or do something out of your comfort zone, you would learn new things about yourself and better understand who you are. Without new situations that require change, you will have no impetus to learn or improve yourself or your abilities.
Improvement and growth are only possible with change.”
You can become more adaptable and flexible. Some of us repeat the same activities and routines daily — we are creatures of habit! However, embracing and accepting change can be challenging if you get too comfortable with your schedule. And sometimes, resisting change can do
more harm than good. As the world around us changes, we must adjust as well. Being open to new ideas, perspectives, routines, and processes puts you in a position to be resilient and adaptable, which helps you in your personal life and workplace. Change allows you to improve and grow. Improvement and growth are only possible with change. If we live a stagnant life, we could miss dozens of incredible opportunities and experiences! We can gain confidence and motivation by opening ourselves up to a new venture or way of doing things. We don’t realize how strong we are until we’re put to the test, and success helps us feel more motivated and eager to make additional changes to enhance our lives.

This month, I implore you to leave your comfort zone and try something new! You may be surprised at the benefits you will experience.

Summer is one of the best times of the year to travel. Kids are out of school and want to do something fun every weekend, which can be difficult to accommodate if you’ve already exhausted your local options. If you’re looking to travel, you CHECK OUT SOME OF AMERICA’S BEST ZOOS MONKEY AROUND THIS SUMMER
PERSONAL INJURY CASES ARE CHANGING!
can visit a beach, take in the sights and sounds of an amusement park, or spend some time with animals while visiting a zoo. Nearly every state in our country has a handful of zoos or aquariums, but some stand above the rest.
Here are three of the best zoos you can visit in the U.S.
Omaha’s Henry Doorly Zoo and Aquarium The Henry Doorly Zoo and Aquarium in Omaha, Nebraska, is consistently ranked as one of the top five zoos in the world. It prides itself on hosting rare, endangered animals you can’t see elsewhere. It has the world’s largest nocturnal exhibit, and one of the major highlights is the Desert Dome, an 84,000-square-foot indoor desert that maintains an authentic desert ecosystem. This is a must-visit for any animal lover in your family.
“Sam did an excellent job at handling my criminal case. I couldn’t have asked for a better defense attorney. He frequently communicated with me through the whole process, and in the end, he got all of the charges dismissed. 10/10 would recommend him to anyone searching for a good defense attorney.” –Joe B. A MESSAGE FROM THE FAITHFUL
The Bronx Zoo You don’t usually think about seeing exotic animals when you visit New York City, but the
Bronx Zoo is one of the best places to view animals in America. Opened in 1899, the Bronx Zoo is responsible for many of the advancements relating to animal captivity. This was one of the first zoos to ditch cages for natural environments and create an animal hospital. With over 6,000 species, there’s an animal for everyone at the Bronx Zoo.
The Living Desert Zoo and Gardens
While the San Diego Zoo is often boasted as California’s largest and best zoo, another zoo is worth checking out. The Living Desert Zoo and Gardens outside Palm Springs has entertained visitors for decades. There are events at this zoo every day, one of the most popular being the keeper connections and animal encounters, where you get up close and personal with the animals while learning more about their habitats and lifestyles.

YOUR LEGAL RESOURCE Changes To The Statute Of Limitations Initially, if you received injuries from an accident or negligent act, you would have four years to file a lawsuit against the aggravated party. However, with HB 837, you only have two years to file a claim. In late March 2023, Governor Ron DeSantis signed the Florida Tort Reform Act, which immediately went into effect. This law changes quite a few legal processes — especially personal injury cases. Here’s what you need to know. Changes Within Comparative Negligence Before HB 837 went into effect, a Plaintiff could receive some compensation in a negligence case, even if they were at fault. For example, if the Plaintiff was 60% responsible for a car accident, they could collect 40% compensation to cover damages. But this is no longer the case. You will not receive compensation if you are 50% or more responsible for an accident or other negligent act. What Is HB 837? We understand how challenging it can be to navigate your personal injury case. That’s why we walk alongside you every step of the way. We will explain terms, documents, and processes in a way you will understand as we help take some of the pressure off your shoulders. Along with assisting you with your personal injury claim, we will share news and information that could affect your case and how we go through our procedures. And today, we have news that will change many of Florida’s legal processes — Florida Tort Reform, otherwise known as HB 837.
Changes Within Medical Evidence Before HB 837, the Jury was to evaluate the case based on what the health care provider billed. This is no longer the case. This bill restricts what a doctor can charge for the services they perform. It doesn’t sound like a free market anymore, does it?
Lastly, a huge change is that if you sue your insurance company, you no longer get statutory attorney’s fees if you win. Prior to the passing of this bill, your insurance
company was more likely to pay you what you deserve because if they didn’t, they could get sued and pay attorney’s fees. Now even if they lose, they are not automatically entitled to pay attorney’s fees. I think we will be seeing more low-ball settlements as a result.
These new changes can be confusing, and you may need help understanding how this new law will affect you. Therefore, if you have any questions or
concerns regarding Florida Tort Reform, please call The Law Office of Matthew Konecky. We will be happy to assist you during this time.

MASTER THE WAVES Ocean Activities the Entire Family Will Love Summer has finally arrived, and many of us will be going on weeklong excursions to the coast to get some much-needed rest and relaxation by the beach. For years, the beach has been one of the most popular summertime destinations for Americans, with millions of us flocking to the coast every year. If you’re planning to hit the sand this summer, you should prepare some exciting activities, so you and your family or travel partners can create memories that will last a lifetime.
Here are a few oceanside activities you’ll want to check out on your vacation.
Explore through snorkeling. Many people want to try scuba diving while on vacation but don’t have the time, training, and finances required to go on an excursion. That being said, you can get pretty close to the scuba-diving experience by snorkeling. Using a snorkel in the ocean, especially in flat water, is a great way to explore the underwater world. You’ll be able to spot fish, crustaceans, and other sea life without needing extensive training. Those who regularly go snorkeling see it as a form of therapy that helps them relieve stress and anxiety. Feeling more relaxed and at peace will help make your vacation feel even more magical. Grab a board. If you want to experience something slightly more intense, you can try some of the many ocean activities involving a board. First-time ocean-goers will love using a boogie board or bodyboard to ride the waves into shore. Those who are more experienced may enjoy surfing for the first time or renting a standing paddleboard. Many beaches on the Atlantic and Pacific coasts have paddleboard rentals or surfing lessons. Be on the lookout at your vacation destination if you want to take advantage of these exciting activities. Tour the ocean. You may want to get away from the beach and experience open waters beyond the shore. If that’s the case, you’ll want to see if your vacation destination offers glass-bottom boat or submarine tours. Some beaches even have whale-watching adventures, which provide an excellent opportunity to see some of nature’s largest creatures in their natural habitat.
