Conclusion The increasing vibrancy of the
development sector and the pressure it places on procurement timetables can often leave the contractual framework struggling to keep up. Prevailing market conditions dictate that developers and even contractors seeking to drive a project forwards to completion may be forced to accept more risk than might previously have been the case. In these circumstances, considerable care must be taken to devise and implement the most robust contractual protection possible. The greater flexibility currently required in the contractual framework demands greater vigilance, all of which makes for an interesting time for contract draftsmen.
