Offshoring & Data Protection
PII Protection Personal Identifying Information (PII) must always be protected through encryption, secure transmission protocols, and restricted access controls. California SB 909 Passed in 2012, this law requires comprehensive disclosure of all offshore processing of consumer information in background checks. Transparency Requirements Privacy policies must clearly disclose information regarding offshoring practices and must be conspicuously posted and easily accessible. When evaluating screening providers, ask specific questions: Which countries process data? What security certifications do offshore facilities maintain? How is data transmitted and stored? What happens if there's a breach?
