حماية الشعب الفلسطيني: ضرورة يف ميثاق األمم املتحدة والقانون الدولي اإلنساني Protection of the Palestinian people: a necessity in the Charter of the United Nations and international humanitarian law * Omar Saadallah - عمر سعد هللا ملخص تواجــه حمايــة الشــعب الفلســطيني المحتــل، المنصــوص عليهــا فــي ميثــاق األمــم المتحــدة والقانــون الدولــي اإلنســاني، تحديــا خاصــا في ظل السياســات اإلســرائيلية، المتمثلــة فــي العنصريــة واإلبــادة والتطهيــر العرقــي منــذ خمــس وســبعين عاما. وقد اعتمدنــا لمواجهة ذلــك، على عدد كبيــر مــن القواعــد التــي تنطبــق فــي النــزاع المســلح الدولــي واكتســبت وضعــا عالميــاً، ســواء أكانــت مــادة قانــون تعاهدي، أم مــادة قانــون عرفي، الخاصــة بالحمايــة القانونيــة زمــن االحتــ ل. ويناقــش هــذا المقــال المعايير والمبــادئ واآلليــات القائمــة علــى حماية حقوق اإلنســان، ويقيــم آثارها على وضع حقوق الشعب الفلسطيني من وجهة النظر القانونية. الحمايــة، االحتالل، ميثاق األمم المتحــدة، القانون الدولي الكلمــات المفتاحيــة: اإلنساني، فلسطين، إسرائيل. Abstract: The protection of the occupied Palestinian people, as stipulated in the United Nations Charter and international humanitarian law, faces a particular challenge due to Israeli policies of racism, ethnic cleansing and genocide over the past 75 years. These policies persist despite the existence of numerous rules that should be observed in international armed conflicts and have acquired global formulations, whether as treaty law or customary law, pertaining to legal protection during occupation. Hence, this paper discusses the standards, principles and mechanisms that are based on the protection of human rights and evaluates their impact on the situation of Palestinian rights from a legal perspective.
